Dynamic Acquisition System of the Municipality of Castelló – Conditions for participation and contractual performance

The input text describes, from the perspective of the Spanish Public Administration (Municipality of Castelló, Spain), the establishment and operation of a Dynamic Acquisition System (DAS) for the supply of materials and products of current use.

It is based on Law 9/2017 on Public Sector Contracts (LCSP) and its regulations, and regulates both the access of companies to the system and the award and execution of specific supply contracts.

No other countries are mentioned except generic references to Community and non-Community companies that want to contract with the Spanish Administration.

Regarding what the tenderer must submit and the minimum requirements, the text establishes that interested companies must submit a "Request to participate" (About/File 1) in accordance with the model in Annex I, accompanied by a Responsible Declaration in accordance with the European Single Procurement Document (ESPD) according to Article 140 LCSP.

In addition, they must prove capacity to act (writing of constitution and statutes registered, DNI and registration in IAE, registration in foreign registers, etc.), specific professional authorization when appropriate, and be aware of tax obligations and with the Social Security, and the City Council can check it ex officio unless expressly opposed.

For economic solvency, annual turnover in the CPV domain of the category is required at least equal to the estimated annual value of that category; this is evidenced, for example, by standardised models of depositing accounts in the Commercial Register or inventory books/tax settlements.

For technical solvency, it is required to have made supplies of the same or similar nature in the last three years, indicating the amount, date and recipient, or quality control certificates for start-ups, accredited by customer certificates or responsible declaration.

It provides for the accumulation of solvency in joint ventures, the use of external means with commitment according to Article 75 LCSP and, as an important exception, the exemption from proving economic and technical solvency for supply contracts with an estimated value of less than € 35,000, both for access to the DPS and for the award of contracts based on it.

The overall estimated value of the system amounts, for example, to €464,270.45 net of VAT (€561,767.24 including VAT), broken down by category, which sets annual estimated values, such as €9,865.57 for stationery and office or €55,462.26 for food.

The minimum time limit for the submission of tenders in each based call for tenders is 10 days from the sending of the invitation (half-decreasable in urgent processing), while the time limit for submitting requests to participate in the DPS is 30 calendar days from the publication of the notice.

As regards award criteria and weighting, the specifications provide as a general rule for Option A, which consists of awarding the lowest price, with a maximum valuation of 100 points, to the minimum value tender, applying an inversely proportional formula Vi = (Omin/Oi)*100; if there is only one tenderer without a withdrawal, 50 points are awarded to him, and if he does not submit a withdrawal in competition, 0 points are awarded to him.

Option B is also considered where the technical unit justifies other criteria: the price is valued with a maximum of 70 points (Vi = (Omin/Oi)*70) and up to 30 additional points are attributed to objective economic or qualitative criteria, always subject to automatic and detailed valuation with their weighting in the invitation.

As a tiebreaker criterion, it is indicated, for example, to value companies with social and labor measures that favor equal opportunities between women and men, or, in another section, to the bidders with the highest number and percentage of permanent workers with disabilities in the workforce; abnormally low tenders are defined in accordance with Article 149 LCSP and Article 85 RGLCAP (10-25% thresholds according to the number of tenderers).

It is a reason for exclusion to bid above the type of tender or with guarantee periods below the minimum.

As regards special risks and conditions, the DPS does not require a definitive guarantee for specific contracts, given that their individual estimated value is less than €15 000 net of VAT, and does not provide for price revisions.

As special conditions of execution, social obligations are emphasized (safety and health at work, application of the sectoral/territorial collective agreement, payment of wages, compliance with the commitments offered), environmental (minimize waste and ensure correct management), and fiscal transparency (declare and fully tax profits without illicit relations with tax havens).

As regards contradictions or corrections within the documents, the specification itself clarifies that, in the event of discrepancies between it and other contractual documents, the provisions of the tender specifications prevail.

There are apparent divergences in the required solvency: on the one hand, it is stated, given the contractual nature, that it is necessary to prove economic, financial and technical solvency with an annual turnover equal to or greater than the estimated annual value of the category; on the other hand, it is indicated that, in accordance with Articles 92 and 159.6.b LCSP and 11 RGLCAP, candidates are exempted from proving economic and technical solvency because the derived contracts do not exceed the threshold of the abbreviated simplified procedure, and additionally a specific exemption is established for supply contracts whose estimated value does not exceed € 35 000.

The applicable interpretation, taking into account the principle of prevalence of the specifications and the detail of the exemption clause, is that the solvency requirement governs as a general rule for access to the DPS and categories, but it is not required to prove it for those specific DPS supply contracts whose estimated value is ≤ € 35,000, a situation that coincides with the raison d'être of the system (expediting recurring small-value contracts).

Likewise, when formal defects are detected in electronic signatures or in the ESPD, the Contracting Bureau applies the anti-formalist principle and allows correction within five working days, tenders being valid once these defects have been corrected; therefore, the Bureau decisions in the minutes rectify and complete the strict application of the initial formal requirements.

Taktik
