Public Tender – Supply of Cardiac Surgery Medical Devices for General Hospital Celje
The input text is a Slovenian public procurement dossier for an open procedure under ZJN-3 for the “Supply of Medical Devices for Cardiac Surgery for a period of 4 years” for Splošna bolnišnica Celje.
It contains instructions to tenderers (OBR‑1), a framework agreement template (OBR‑2) and all mandatory forms.
The point of view is that of a Slovenian public hospital as contracting authority, operating under Slovenian law and EU law (notably MDR 2017/745, IVDR 2017/746, sanctions against Russia, and EU transitional regulations).
Countries explicitly involved are Slovenia (national law, JAZMP registry, public finance rules) and EU member states (for recognition of foreign registrations, EUDAMED, CE marking, EU sanctions on Russian entities).
Regarding what bidders must submit and minimum qualification, the tender requires electronic submission via e‑JN in Slovenian language, with all proof documents translated into Slovene (technical catalogues etc. may be in English).
Mandatory content of the offer includes, such as: signed framework agreement template OBR‑2; OBR‑3 (statement on ownership structure / participation of physical and legal persons); OBR‑4 (Ponudbeni predračun – summary offer); OBR‑10 (detailed Excel price schedule, also as PDF); OBR‑5 or OBR‑12 (security for good performance – menična izjava or guarantee per EPGP‑758); OBR‑7 or OBR‑11 (bid bond – 3 % of offer value excl.
VAT, via bill of exchange in physical form or bank/insurance guarantee per EPGP‑758); OBR‑6 (statement of compliance with technical specification plus original manufacturer prospekti); OBR‑8 (supplier data); OBR‑9 (Russia sanctions statement); filled ESPD for all economic operators (bidder, partners, subcontractors, capacity‑providing entities).
Bidders must also attach technical supporting documentation under point 15.4 (CE certificates, EU declarations of conformity, proof of MDR/IVDR transitional regime, safety data sheets) and, where CE is not legally required, their own declaration explaining that for the offered material CE marking is not required.
Minimum professional capacity includes being registered for the relevant activity and being entered in the appropriate JAZMP registers (or equivalent foreign register with sworn translation), and for manufacturers/authorized representatives/importers registration of the devices in EUDAMED by the bid deadline.
Basic eligibility and exclusion grounds (no convictions, no labour or “zaposlovanje na črno” violations, compliance with 5k of Council Regulation 2022/576 re Russia, etc.) are declared via ESPD; every nominated subcontractor and consortium partner must independently meet these criteria and submit their own ESPD.
The scope of the contract is defined as a four‑year framework agreement for the supply of various cardiac surgery medical consumables, divided into 81 lots (sklopi) with item descriptions and indicative quantities in OBR‑10.
As indicated, such as: the hospital will order only what it actually needs, within its secured funds; the list and quantities are expressly described as “okvirne” (approximate).

The place of performance is Splošna bolnišnica Celje, pharmacy/warehouse at Oblakova ulica 5, with delivery under Incoterm DDP (2020), unloaded at the hospital pharmacy on workdays (usual hours 7:00–14:00 / 7:00–15:00 depending on activity).
The framework runs 48 months from signing or until funds are exhausted, whichever is sooner, and is planned to start around December 2026.
During the framework, supplies are ordered by written purchase orders; for items marked as consignment stock in OBR‑10, the contractor must establish and replenish monthly consignment stock at the hospital pharmacy, with ownership staying with the supplier until actual use (tracked in LIRWIN).
The hospital reports monthly consumption; the supplier may invoice only for consumed items.
For consignment, replenishment must normally occur within two days (24 hours in urgent cases), and at contract end the supplier must take back unused stock.
Award criteria and weighting are straightforward and purely price‑based.
At framework‑award stage, the contracting authority selects up to three suppliers per lot based solely on the lowest total price in EUR including VAT for the predicted quantities in OBR‑10; no quality or other non‑price criteria are applied.
Within the framework, for each “opening of competition” (predvidoma every 2 years or ad hoc when new items are needed) and for each specific order, the only criterion remains, such as: the lowest price in EUR with VAT for the requested scope.
For the first supply period (roughly two years), orders are placed with the supplier who offered the lowest overall price; subsequent mini‑competitions among framework suppliers use the same lowest‑price criterion.
If two or more offers have exactly the same total price, the award is decided by public drawing of lots, either in person or via videoconference; only tenderers with equal compliant prices are invited, and a record of the draw is sent to absent participants.
Risks and special conditions are numerous and detailed.
Financial guarantees include a 3 % bid security valid six months from contract notice; if the bidder withdraws or modifies the offer during its 6‑month validity, refuses to sign the framework within five working days of invitation, or fails to provide the 5 % performance security, the bid security is unconditionally called.
The 5 % performance security (based on estimated contract value including VAT) must be valid for the duration of the framework plus 30 days; it is a condition for the framework to become effective and may be enforced in cases such as non‑performance, late delivery, supply of non‑conforming goods, inability to supply quantities, or termination due to supplier breach.
The documents define “kritni kup”: if deliveries are late, missing, or defective, the hospital may buy from another framework contractor or on the market and charge the original supplier the price difference; repeated issues leading to three such chargeable events allow immediate termination and calling of the performance guarantee.
There are specific obligations and risks relating to MDR/IVDR and vigilance (e.g. mandatory CE marking, maintenance and replacement of certificates and declarations, obligation to notify FSN, recalls, status changes within 5 working days, supplier bears all recall costs).
For labour‑law breaches or corruption, there is a resolutory clause: the framework is void or terminable if corruption is established or if final decisions show the contractor or its subcontractor has committed certain labour or “black work” offences; the hospital can require evidence of “self‑cleaning” or subcontractor replacement.
Subcontracting is allowed but not mandatory for this supply contract; any subcontractor with direct payment must accept direct invoicing/payment mechanisms, and all changes in subcontractors must be notified within 5 days and approved by the contracting authority, which can refuse changes; for joint bids, partners are jointly and severally liable, cannot be replaced during execution, and must formalize their cooperation in an internal agreement.
The validity period of the offer is explicitly six months from bid opening, with the contracting authority reserving the right to request extensions.
Questions and clarifications are permitted exclusively via the national portal enarocanje.si up to the deadline published there; the authority must respond at least six days before the bid deadline, and any information posted on the portal that changes or clarifies the documents becomes part of the tender conditions.
No site visit is mentioned or required.
Regarding contradictions or corrections, the text repeatedly emphasizes that the published documentation and any official amendments/clarifications on the Portal javnih naročil are binding, and that in case of discrepancies, such as: between the PDF “offer summary” OBR‑4 uploaded as “Predračun” and the detailed Excel “Predračun” OBR‑10 uploaded under “Drugi dokumenti”, the Excel OBR‑10 is expressly stated to prevail as the valid data source.
Similarly, in case of language discrepancies, the Slovenian version of the documentation and bid prevails; if a part exists only in a foreign language, that foreign version governs.
The document also clarifies that changes to the tender documentation close to the deadline automatically lead to deadline extensions where necessary, and that the contracting authority can modify or complete the documentation only before the bid deadline; after that, no further changes are allowed.
Within the framework agreement, there is a conditional price‑indexation clause (based on the “Pravilnik o valorizaciji” and life‑cost index) that applies only if the framework is concluded with a single supplier; the clause is explicitly to be deleted (and thus not applicable) if the framework is awarded to several suppliers.
