Annex 1A and 1B to the tender specification The Contractor attaches to the tender. By filling in the items indicated in Annex 1B to the tender specification, the Contractor confirms that the requirements specified by the Contracting Authority have been met. 3. The tendered items must be complete, of a high standard both in terms of quality and functionality, and free from material, construction and legal defects. 4. The tendered item must be released for free circulation and use in accordance with the applicable law. 5. In all the provisions of the tender specification and its annexes, which indicate the trade marks, parameters, sources or specific process that characterises the products supplied by a specific origin contractor (names of manufacturers or equipment), in accordance with Article 99(5) and where the subject of the contract is described by reference to standards, technical assessments, technical specifications, reference systems, in accordance with Article 101(4) of the Public Procurement Act, the Contracting Authority accepts equivalent solutions. In such a case, the Contractor is obliged to prove in the tender, in particular by the means of evidence concerned, that the proposed solutions meet in an equivalent manner the requirements set out in the description of the subject matter of the contract. 6. The Contracting Authority does not reserve the right to apply for the contract only to the Contractors referred to in Article 94 of the Public Procurement Act. 7. The Contracting Authority does not impose the requirements referred to in Article 96(2)(2) of the Public Procurement Act.
