Regarding what the bidder must submit and minimum qualification, the Aufforderung zur Angebotsabgabe (Formblatt 211) and Verzeichnis der im Vergabeverfahren vorzulegenden Unterlagen (Formblatt 216) specify: with the offer, bidders must submit the Angebotsschreiben (Formblatt 213) and the completed Leistungsverzeichnis with prices. Depending on the bidder’s situation, they may also have to submit form 233 (Verzeichnis der Nachunternehmerleistungen) if parts are subcontracted, form 234 (Erklärung Bieter-/Arbeitsgemeinschaft) if bidding as a JV, form 235 (Leistungen/Kapazitäten anderer Unternehmen) if they rely on other firms, and the Instandhaltungs-Vertragsformular plus ggf. Formblatt 224 (Lohngleitklausel) and 248 (Holzprodukte), when applicable. For non‑präqualifizierte Unternehmen, the Eigenerklärung zur Eignung (Formblatt 124) is required as preliminary evidence of suitability, including turnover over the last three financial years for comparable works and the declaration of comparable projects in the last five calendar years. If the offer comes into the “engere Wahl”, the bidder must—on separate request—provide reference certificates (three references with detailed technical and quantitative information), workforce statistics, trade/Chamber registrations, insolvency plan confirmation (if relevant), tax and Sozialkasse “Unbedenklichkeitsbescheinigungen”, Berufsgenossenschaft certificate, Freistellungsbescheinigung nach § 48b EStG and, as applicable, product data sheets and proof of equality for certified wood products (PEFC/FSC). Präqualifizierte Unternehmen instead indicate their PQ-Nummer; in all cases, Eignung is assessed according to § 6a VOB/A, and missing suitability documents required with the bid (except prices) may be nachgefordert according to the Bekanntmachung.

The award criteria and weighting are defined as price-based. As indicated in Formblatt 211 (Ziffer 7) and the Bekanntmachung, the Zuschlagskriterium is “Preis”; the Wertungssumme is calculated from the checked offer sum, including consideration of unconditional discounts, any Erstattungsbeträge from a Lohngleitklausel, and prices for any Instandhaltungsangebote. There is a special treatment for offers from Werkstätten für Behinderte: such offers receive a 15% bonus on the Wertungssumme, and if a workshop’s offer is equally economical as another, the award goes to the workshop. The bidder must provide proof of being a Werkstatt für Behinderte or Blindenwerkstätte with the offer when claiming this bonus. Nebenangebote are allowed (see Bekanntmachung j), but they must meet all Mindestanforderungen, be qualitatively and quantitatively gleichwertig to the base specification, be fully described, and be broken down by quantities and unit prices; otherwise they are excluded from the evaluation.

The documents set out several risks and special conditions. Contractual penalties (Vertragsstrafen) under § 11 VOB/B are provided for in the Besondere Vertragsbedingungen (Formblatt 214): for each working day of delay beyond contractually fixed milestones or completion date, a daily contractual penalty is due, calculated as a percentage of the net contract sum (exact percentage to be ticked by the Auftraggeber), and capped at an overall percentage of this sum. All delay penalties for intermediate deadlines are offset against any penalty for delayed completion. Security: depending on the contract size, there may be no security or, if the net order sum is at least 250,000 €, a performance bond of 5% of the (gross, without supplements) contract value and a defect-security of 3% of the sum of instalments at acceptance; where security is required, prescribed GM.SH forms must be used for performance, defect and advance-payment guarantees. The bidder must also accept a 15% lump‑sum damage payment clause if proven to have entered into an anti‑competitive arrangement, unless a lower damage is shown. Subcontracting is regulated: any use of Nachunternehmer must be declared with scope in the offer and named on request; special security and commitment forms (126, 236) can be demanded later. For “Heißarbeiten” (hot works), the contractor must obtain a formal “Erlaubnisschein” before each such activity, both for construction and later maintenance. Insurance requirements appear in the AMEV Aufzug-Service contract: the contractor must hold liability insurance covering defined levels for Sach-, Vermögens- and Personenschäden. Special procedural risks include the strict prohibition of Mischkalkulationen (redistributing unit prices across positions), which leads to exclusion, and the insistence on documented, proper signatures or electronic seals; if the bidder is not recognizable in a text-form e-bid or required signatures/seals are missing, the offer is excluded.

As to contradictions or corrections within the documents, the text is internally consistent on key points but provides explicit rules on precedence and clarifications. For instance, although GAEB DA-XML data and other electronic files are exchanged, Formblatt 244 makes clear that, unless exchanged via the e‑Vergabe platform as binding bid data, they count only as Arbeitsmittel; in case of discrepancies between electronic exchange files and the written version of the tender or accounting documents, the written version prevails. Similarly, the Teilnahmebedingungen and Angebotsschreiben reiterate that the Langfassung des Leistungsverzeichnisses prepared by the client is alleinverbindlich; any self-made copies or short versions are secondary. Where both the Bekanntmachung and Formblatt 211 address Nachforderung, they align: all documents required with the bid (except prices) may be requested later, and “Alle Unterlagen ... mit Ausnahme fehlender Preisangaben” may be nachgefordert. The apparent dual mention of allowed submission formats (both electronic and written) is resolved by a specific clause in the Bekanntmachung and in the “Wichtige Informationen” sheet: for this open procedure, offers must be submitted exclusively electronically via e‑Vergabe; the written submission rules are template text but are overridden by the explicit statement “Abgabe der Angebote ausschließlich elektronisch über die e‑Vergabe”. In practice, where generic VHB template options seem to conflict, the project-specific ticks and notes (especially in 121, 211, 216, 214, 244) control, and these should be treated as the binding statements for this procedure.
