Procurement documents for floristic records of the LfULG (Saxony) 2027
The documents come from a German procurement procedure of the Free State of Saxony (Sächsisches Landesamt für Umwelt, Landwirtschaft und Geologie – LfULG) for a nature conservation service in 2027.
The legal bases are German public procurement law (VOL/A, SächsVergabeG), the additional contractual terms of the LfULG (ZVB) and EU law, such as VAT and the Sanctions Regulation against Russia.
The perspective is clearly that of a German contracting authority; other countries occur only indirectly, e.g. as EU Member States in relation to intra-Community supplies and Russian companies as excluded actors.
With regard to what the tenderer is required to submit and what are the suitability requirements, the documents regulate in particular the use of the forms provided.
For example, the ‘self-declaration’ must be completed in full and signed in a legally binding manner; It includes, inter alia, declarations on tax liability, minimum wage, professional association insurance, absence of grounds for exclusion under VOL/A and EU sanctions law and, where applicable, discount information.
The following must also be submitted: a detailed cost calculation (expenses according to man-hours and hourly rates, fixed price net with indication of the VAT rate, including all ancillary costs) and – for technical and technical capacity – (a) designation of a responsible contact person, (b) references to floristic and vegetation mapping in the open country of the last three years, (c) names, qualifications and tasks of the intended employees and (d) a presentation of internal quality assurance.
Where subcontractors are used, a list of partial services and subcontractors must be attached; in the case of a qualifying loan, a declaration of commitment by the subcontractor.
For consortia, a list of members and a declaration of representation and joint and several liability signed by all members must be provided.
With regard to the scope of the contract (scope), the documents determine that these are floristic records of care variants of a multi-year flower mixture at a test site of the LfULG in Nossen.

This clarifies that in the case of obvious contradictions, the more specific rules of the tender specifications take precedence, then the CA, etc. Corrections and clarifications during the procedure are made via the procurement platform; it is the tenderer's own responsibility to obtain regular information there.
