Procurement documents for floristic records of the LfULG (Saxony) 2027
The documents come from a German procurement procedure of the Free State of Saxony (Sächsisches Landesamt für Umwelt, Landwirtschaft und Geologie – LfULG) for a nature conservation service in 2027.
The legal bases are German public procurement law (VOL/A, SächsVergabeG), the additional contractual terms of the LfULG (ZVB) and EU law, such as VAT and the Sanctions Regulation against Russia.
The perspective is clearly that of a German contracting authority; other countries occur only indirectly, e.g. as EU Member States in relation to intra-Community supplies and Russian companies as excluded actors.
With regard to what the tenderer is required to submit and what are the suitability requirements, the documents regulate in particular the use of the forms provided.
For example, the ‘self-declaration’ must be completed in full and signed in a legally binding manner; It includes, inter alia, declarations on tax liability, minimum wage, professional association insurance, absence of grounds for exclusion under VOL/A and EU sanctions law and, where applicable, discount information.
The following must also be submitted: a detailed cost calculation (expenses according to man-hours and hourly rates, fixed price net with indication of the VAT rate, including all ancillary costs) and – for technical and technical capacity – (a) designation of a responsible contact person, (b) references to floristic and vegetation mapping in the open country of the last three years, (c) names, qualifications and tasks of the intended employees and (d) a presentation of internal quality assurance.
Where subcontractors are used, a list of partial services and subcontractors must be attached; in the case of a qualifying loan, a declaration of commitment by the subcontractor.
For consortia, a list of members and a declaration of representation and joint and several liability signed by all members must be provided.
With regard to the scope of the contract (scope), the documents determine that these are floristic records of care variants of a multi-year flower mixture at a test site of the LfULG in Nossen.
The exact technical specifications – such as survey methods, reporting structure, database formats – are set out in the tender specifications; This includes the submission of an Access database, a Word report, image files according to separate specifications and a short version for the internet presentation.
The location of the service is the Nossen test site and the digital delivery of the work results to the Department of Nature Conservation and Landscape Conservation in Freiberg via the Saxon data exchange portal SiDaS.

The execution deadline is precisely defined for the period from 01.06.2027 to 04.11.2027, with intermediate deadlines (e.g. draft final report by 18.10.2027, agreed final report by 04.11.2027).
The closing date for the submission of tenders is 26.11.2026 and the closing date is 29.01.2027.
Lots are not formed; Subsidiary offers are expressly inadmissible.
As regards the award criteria, the documents clearly state that the contract will be awarded exclusively on the basis of the price (‘100% price’).
This means that all minimum functional and qualitative requirements (e.g. staff qualifications, references, quality assurance, compliance with formal requirements) act as suitability and minimum criteria; only an economic comparison is made between the appropriate offers on the basis of the fixed price offered.
Prices must be quoted in euros, with two decimal places and excluding value added tax (net), with a separate indication of the applicable VAT rate.
A later examination according to the price regulation PR No. 30/53 is possible; in the event of an inadmissible price, the price permitted under price law shall apply.
The ZVB-Werk contains extensive regulations on risks and special conditions, which are supplemented by the terms of reference.
For example, all prices offered are fixed prices covering all costs including insurance, transport, ancillary services and rights of use; Additional allowances (e.g. travel expenses) are only granted if expressly agreed in writing.
Strict deadlines and penalties apply: In the event of delay (including partial performance or intermediate periods), a penalty of 0.5% of the net contract amount per week of delay may be imposed up to a maximum of 5%; In addition, compensation for damages remains possible.
The contractor must have liability insurance; their removal may result in termination.
Use of subcontractors is only permitted with the prior written consent and with the passing on of the VOL/B conditions, whereby the contractor remains fully responsible.
Communication is generally in German; Tenders must be submitted in writing by post/delivery service only, clearly identifying the envelope.
Tenders must be complete, signed and submitted in due form; Fax, e-mail or electronic submission are excluded and lead to the exclusion of offers.
Questions relating to the procurement documents must be submitted by e-mail or via the procurement platform within a reasonable time before the closing date for the submission of tenders; Telephone information will not be provided.
An obligation to participate in a site visit is not mentioned.
In the event of contradictions or corrections, the ZVB shall establish a clear ranking of the contractual documents in order to resolve any ambiguities.
In the case of conflicts, the following shall apply successively: (a) Specifications including form ‘self-declaration’, (b) Contractor’s offer, (c) any special contractual conditions/ZVB-AVV, (d) ZVB of the contracting authority, (e) VOL/B, (f) legal regulations, (g) technical contractual conditions, (h) recognised rules of technology.
In addition, the service description expressly states that, in all other respects, the ZVB apply, unless they are modified by deviating provisions of the service description.
This clarifies that in the case of obvious contradictions, the more specific rules of the tender specifications take precedence, then the CA, etc. Corrections and clarifications during the procedure are made via the procurement platform; it is the tenderer's own responsibility to obtain regular information there.
Only the contracting authority's tender documents are binding. As of: 30/10/2026
