The scope of the contract is defined as Schreinerarbeiten (joinery) for built-in school furniture. Such as: Bühnenkonstruktion Pausenhalle (approx. 38.5 m² plus ramp and intermediate step), Einbaugarderoben (around 114 lfm Sitzbänke mit Rückwänden, ca. 113 lfm Garderoben-Schuhunterschränke), Personal-Schließfächer (ca. 32 lfm), Einbauküchen/Teeküchen/Lehrküchenmöbel (ca. 114 lfm Unterschrank-/Sockelzeilen), Einbauschränke in the Pausenhalle (2 × ca. 4.80 m plus sliding-door unit ca. 14.7 m²), 34 Mediensäulen/-möbel, 29 HPL-Spritzschutz-/Waschbeckenplatten. The place of performance is Am Sonneneck 41, 87600 Kaufbeuren (Germany). The contract period is scheduled from 11.01.2027 to 01.10.2027, with Ausführungsbeginn 2. KW 2027 and Fertigstellung 39. KW 2027; Bauablaufbedingte Verlängerung is possible. The LV and Anlage 05 “Fördermittelanforderungen” add extensive DGNB/QNG material and product requirements (e.g. REACH conformity, VOC limits, SVHC declarations, wood origin and chain-of-custody) that are contractually owed and priced within specified LV positions (“Mehraufwand Fördermittel / DGNB – QNG”).

The award criteria are set out very clearly. Such as: both in L 211 EU and in the TED notice, the sole Zuschlagskriterium is “Preis”; the price is determined from the nachgerechnete Angebotssumme including any unconditional discounts duly indicated in the Angebotsschreiben. There are no qualitative weighting factors; all other requirements (Eignung, DGNB/QNG, formalities) operate as mandatory conditions and exclusion criteria, not as scored award criteria. The documents also clarify that variants (Nebenangebote) are not permitted for this procedure (L 211 EU: Nebenangebote sind nicht zugelassen; Nr. 5 der Bewerbungsbedingungen EU gilt nicht), and that multiple Hauptangebote are not allowed according to the TED notice (“Die Bieter können mehrere Angebote einreichen: Nicht zulässig”).

Risks and special conditions for bidders are extensive. Such as: strict exclusion rules (GWB §§ 123–126, VgV §§ 56–57, MindestlohnG, AEntG, SchwarzArbG) and an obligation to detect and report any perceived errors or ambiguities in the documents before bid submission. The offer must remain valid for 61 days from submission (Bindefrist) and late or non‑conforming offers are excluded unless the bidder is demonstrably not responsible. Use of Unterauftragnehmer is closely regulated (suitability per §§ 122, 128 GWB; prior notification; cascading subcontracting only with prior notice). DGNB/QNG requirements represent a major technical and economic risk, as all material-specific constraints, documentation, audits and replacements of non-compliant products are contractually owed and covered by LV pricing, with replacements at the contractor’s cost if criteria are not met. There are also obligations around documentation (Bautagebuch, plan management, revision documents), site rules (no own firm signs, no EV charging) and daily cleaning and waste disposal at the contractor’s cost.

Regarding contradictions or corrections, the documents generally cross‑refer and align. Such as: L 124 (Eigenerklärung) mentions three references from the last three years, but the TED notice and L 211 EU clarify that the actual requirement is at least two comparable completed projects in the last five years; the notice explicitly states that the Bekanntmachung’s deviating timeframe prevails (“Soweit in der Bekanntmachung ein abweichender Zeitraum angegeben wurde, ist dieser maßgebend”). Similarly, although L 213 includes an optional KMU declaration and mentions that the procurement is suitable for KMU, the TED notice states “Diese Auftragsvergabe ist auch für kleine und mittlere Unternehmen (KMU) geeignet: nein” – the TED statement is decisive for the market suitability classification, but does not create an additional exclusion criterion. On Nebenangebote, L 212 EU describes conditions for side offers, yet L 211 EU for this specific procedure explicitly excludes Nebenangebote, so the specific form (Aufforderung zur Angebotsabgabe) overrides the general template. Where the templates offer alternatives (EEE vs. L 124 vs. AVPQ), the TED notice and L 211 EU clarify that an ausgefülltes L‑124 or EEE plus the ability to supply listed certificates within six calendar days on request is required; failure to provide requested follow‑up proofs within the deadline leads to exclusion as reiterated at the end of L 124.
