The scope of the contract is described as one lot (LOT-0000) “Foerderanlagen”, covering installation of 1 freight lift (Lastenaufzug), 1 passenger lift (Personenaufzug) and 1 passenger/freight platform lift (Personen-/Lastenhubbühne) including extensive ancillary works such as shaft equipment, platform doors, control systems, provisional construction-time operation, vibration measurements, safety training (TRBS 3121), documentation and commissioning. Such as: specific LV positions for the person/freight lift (3500 kg, 46 persons, 4 stops) and for the hub platform (1200 kg, 2 stops, defined platform size), as well as scaffolding and cable tray work. Place of performance is Erlangen, postcode 91058 (NUTS DE252). Time-wise, the contract runs from 08.02.2027 to 02.11.2029, with binding individual contractual milestones under the Besondere Vertragsbedingungen (214.H): start of carrier installation 01.04.2027, start of lift installation 13.09.2027, provisional lift operation for site use from 13.12.2027, and start of platform lift installation 15.01.2029. Bidders must submit a bar-chart construction schedule (Bauzeitenplan) showing activities, dates and interim deadlines; the binding contract deadlines derive from that plan plus the specified dates.

Award criteria and weighting are straightforward. Such as: the procurement documentation and TED notice explicitly state that price is the sole award criterion. Risks and special conditions are set out mainly in the participation conditions (212EU) and the Besondere Vertragsbedingungen (214.H). Such as: there are contractual penalties (Vertragsstrafen) under § 11 VOB/B, with daily penalties for delay in contractual milestones and in completion, capped at a percentage of the net contract sum (exact figures to be taken from the completed contract form) and with cumulative penalties for multiple delayed milestones being offset against the overall penalty cap. Similarly, 214.H has template clauses saying that performance and defect securities are “waived” or “to be determined by percentage”; the TED notice then fixes the percentages at 5% for performance and 2% for defects, so those specific percentages are applicable. Another apparent tension is that 211 EU allows both electronic and written submission options, while the TED notice states “Elektronische Einreichung: Erforderlich”; therefore, for this procedure only electronic submission via the RIB platform is permitted. Lastly, Form 216 and the TED notice both list qualification documents; the consistent rule is: Form 124 (or EEE) must be submitted with the offer as self-declaration; the detailed certificates (turnover proofs, reference certificates, registrations, tax/social clearance, BG certificates, etc.) will be requested afterwards under § 16a EU VOB/A for bidders in closer consideration, and must then be provided within the set deadline by both the main bidder and any named subcontractors or capacity providers.
