Vergabeunterlagen „Einzelfallstudie AL 7 – Artenreicher Ackerrandstreifen, 2027“ (LfULG Sachsen)
The input text concerns a German national public procurement procedure conducted by the Freistaat Sachsen, vertreten durch das Sächsische Landesamt für Umwelt, Landwirtschaft und Geologie (LfULG).
It sets out the conditions for a Werkvertrag on the “Einzelfallstudie AL 7 – Artenreicher Ackerrandstreifen, 2027”, i.e. a case study within the agrienvironmental measure AL 7 under the EPLR.

The Angebotsfrist ends on 19.11.2026, Bindefrist is until 22.01.2027, and the Zuschlag is to be granted in writing within the binding period.
Offers must quote a Festpreis including all incidental costs, and prices must be in euros with two decimal places, shown net plus applicable VAT rate, based on a detailed person‑hours calculation.

Nebenangebote are not permitted in this procedure, as explicitly stated in the Anlage zu den Vergabeunterlagen; any Nebenangebote without a Hauptangebot would be impermissible in any case.
As to risks and special conditions, the contract is a Werkvertrag subject to VOL/B and the LfULG ZVB.
Payment is made once, after acceptance of the Abschlussbericht and all digital deliverables, within 30 days after receipt of a proper invoice; a voluntary Skonto deduction applies if payment occurs within 14 days, per the percentage stated by the bidder in the Eigenerklärung.
All prices are fixed and must include insurance, packaging, transport and all ancillary costs; additional remuneration for side services or IP rights is excluded unless expressly agreed in writing.
The ZVB provide for contractual penalties and the right to Rücktritt/Kündigung in specific cases, such as bribery or undue advantages, lapsing liability insurance, serious breach of performance obligations, or false statements regarding reliability and capability.
Subcontracting without written approval and imposing worse conditions on Nachunternehmer than those agreed with the LfULG are prohibited.
There is a strict confidentiality obligation for all Vergabeunterlagen and performance data, reinforced by data protection requirements under DSGVO; after award, the contractor must fill in a separate “Erklärung Auftragsverarbeitung” specifying technical and organisational measures for processing personal data.
Questions on the tender must be submitted in good time before the Angebotsfrist, and answers are communicated via evergabe.sachsen.de or email, with telephone enquiries expressly excluded.
Any contradictions within the documents are resolved according to ZVB Nr. 1.2, which sets a hierarchy: first the Leistungsbeschreibung including the “Eigenerklärung” form, then the bidder’s offer, then any Besondere Vertragsbedingungen (including AVV for data processing), followed by the ZVB, VOL/B, statutory law, and finally technical standards—meaning that, such as in the differing end dates 01.11 vs. 30.11.2027, the specific Leistungsbeschreibung/Aufforderung governs.
