Dynamic purchasing system for cleaning and hygiene supplies – Ayuntamiento de Alcobendas (SDA 02/2024)
The input text concerns the creation of a Sistema Dinámico de Adquisición (SDA) for the recurrent supply of cleaning products and technical material for the cleaning of public buildings of the Ayuntamiento de Alcobendas (Spain).
It is a Spanish local authority procurement, subject to the Ley 9/2017 de Contratos del Sector Público and to EU Directive 2014/24/EU, with publication in the Spanish national contracting platform and the Official Journal of the European Union.
The point of view is that of a Spanish local contracting authority setting up a dynamic purchasing system, framed by Spanish public procurement law and EU procurement rules.
Such as described in the “Informe Técnico de Necesidad” and the announcement, the SDA covers supplies under CPV 39800000 (cleaning and polishing products) and any similar supplies that may appear on the market during its life.
The estimated value of the SDA is 560,500 EUR (excluding VAT), calculated on the basis of three years of use (285,000 EUR), up to two one‑year extensions (190,000 EUR), plus estimated modifications (20% = 57,000 EUR) and potential 10% increase of units (28,500 EUR).
The system’s initial duration is three years (09/04/2024–09/04/2027), with possible extensions up to a total of five years.
Place of performance is the public buildings of Alcobendas (Madrid, ES300), and each specific contract within the SDA will set its own quantities and detailed technical specifications.
Such as indicated in the announcement and PCAP references, bidders requesting adhesion to the SDA must submit electronic documentation (no paper) in the “sobre” for participation.
This includes: general administrative documents proving capacity to contract, no prohibition to contract, compliance with tax and social security obligations, and, for foreign companies, a declaration of submission to Spanish law (all “según cláusula 11 del PCAP”); proof of registration in the appropriate IAE tax heading where required; a responsible declaration on annual turnover in the relevant activity for up to the last three financial years, evidencing a minimum annual turnover not exceeding 90,000 EUR; and a technical solvency statement listing main similar supplies in up to the last three years, with amounts, dates and clients, reaching at least 80,000 EUR (70% of the annual mean of the best of the last three years).
Technical experience may be accredited by certificates from the competent body or, failing that, a responsible declaration with supporting documents; newly created companies may rely on art. 75 LCSP.
The evaluation report shows that missing elements (e.g. lack of IAE proof or incomplete reference years) can be required within seven working days.

The general award criteria framework for all categories is: economic offer (price) with a weighting minimum of 50 points and maximum of 90 points; delivery time with a minimum of 10 and maximum of 40 points; and quality via “mejora y adaptación a las características del PPT” with a minimum of 0 and maximum of 50 points.
The detailed formulas and exact point allocations will be specified in each invitation for the specific contracts, in line with art. 226.4 LCSP.
The procedure for setting up the SDA is restricted, fully electronic, with a minimum 30‑day period from DOUE dispatch for submission of participation requests, and evaluation of requests within 10 working days (extendable to 15 or more before the first specific contract is invited).
There is no electronic auction phase and no funding from EU programmes.
Such as reflected in the guarantees, penalties and special conditions, the SDA carries several risks and obligations for suppliers.
No provisional guarantee is required, and no general definitive guarantee is demanded merely for joining the SDA; however, invitations for specific contracts may require a definitive guarantee equal to 5% of the awarded contract price (excluding VAT).
Environmental conditions apply as special execution conditions: packaging must be made from recycled and renewable materials, with appropriate labelling, and a signed declaration of compliance must be provided at the start of each specific contract; non‑compliance is classified as a serious breach.
Penalties are established under art. 192 LCSP for defective performance, delays, breach of special conditions or other obligations, with daily delay penalties of 0.60 EUR per 1,000 EUR of the SDA price, and fines for infringements classified as minor, serious or very serious: 2%, 5% or 10% respectively of the specific contract price, with caps at the same percentages of the SDA price.
Multiple very serious breaches may lead to termination of the SDA for that contractor, possible forfeiture of guarantees and liability for damages.
Subcontracting is allowed under art. 215 LCSP but bidders must indicate in their offer the portion to be subcontracted, its amount, and the name or professional profile of subcontractors.
Execution, ordering, invoicing and payments are electronic (e‑ordering, e‑invoicing, e‑payment), and there is no mention of compulsory site visits or formal question deadlines beyond the general platform rules.
For example, the announcement notes that the number of candidates in the SDA cannot be limited, yet a minimum of 5 and maximum of 20 is mentioned in the platform fields: in a dynamic purchasing system under art. 223–225 LCSP, admission cannot be capped, so the “no limit on number of candidates” rule applies, and the numeric range should be read as an indicative field for specific invitations or as a technical platform parameter, not a hard restriction.
Similarly, penalties are described both as percentages of specific contract prices and as caps relative to the SDA price; these formulations are complementary and must be applied together as written in the PCAP (the detailed penalty regime of the pliego governs).
Where the announcement refers generically to solvency criteria “según apartado 5 de la cláusula 1 del PCAP”, the detailed thresholds (90,000 EUR turnover, 80,000 EUR technical volume, 70% annuality) in the PCAP and the technical need report are the operative values.
