Dynamic Acquisition System of the City of Castelló for current supplies
The text deals with the establishment and operation of a Dynamic Acquisition System (SDA) of the City Council of Castelló (Spain) for the purchase of materials and products of common use.
It is drafted from the point of view of the Spanish contracting authority and constantly refers to Law 9/2017 on Public Sector Contracts (LCSP) and state regulations (Royal Decree 817/2009, RGLCAP, etc.).
Contracts from other countries are not regulated, although the participation of companies from other EU Member States and third countries is mentioned, always under the perspective of the Spanish legal system and the jurisdiction of the Spanish courts.
As a general context, the DPS is described as a completely electronic procedure, restricted and open throughout its validity, which seeks to replace minor contracting in recurring supplies and promote competition, especially of SMEs.
It sets a joint estimated value of €464,270.45 net of VAT (€561,767.24 net of VAT) and is divided into supply categories (e.g. stationery, teaching materials, cleaning products, food, beverages, household goods and household appliances) linked to CPV codes.
The territorial scope of implementation is the municipality of Castelló (Comunidad Valenciana), with place of delivery in different municipal areas and overall term of the SDA, for example, from 24/06/2024 to 25/06/2028 for certain categories.
As for what the tenderer must submit and the minimum requirements, it is established that participation begins with a ‘Request to participate’ (Annex I) and an ESPD-type Responsible Declaration in accordance with Article 140 LCSP, in addition to the specific model declaration (Annex II) certifying legal personality, absence of prohibitions on contracting, compliance with tax and social security obligations, and acceptance of Spanish jurisdiction (especially for foreign companies).
As indicated, proof of capacity to act must be provided (writing and statutes registered for legal persons; DNI and registration in IAE for natural persons), specific professional qualification and economic and technical solvency: annual turnover in the field of the CPV equal to or greater than the estimated annual value of the category, and experience in similar supplies in the last three years, with reference to amount, date and recipient.
Accreditation is done through annual accounts deposited in the Commercial Registry or books / tax settlements for individual entrepreneurs, and supply certificates issued by public or private customers; in start-ups, certificates from quality control bodies are required.
It provides for the accumulation of solvency in joint ventures, the commitment to formally establish the joint venture (Article 69(3) LCSP) and, if external means are used, the commitments in Articles 75 and 76 LCSP.
Likewise, it is allowed to replace part of the documentation by certification of the Official Register of Tenderers and Classified Companies or regional registry.
Regarding the scope of the contract (what, how much, where, when), the DPS covers commonly used supplies available on the market, structured by category and CPV; such as: category 1 “Stationery and office equipment” (CPV 30100000), with an estimated annual value of €9,865.57 and a total of €39,462.29; category 2 “teaching materials” €3,216.19 per year and total €12,864.77; other categories are detailed for cleaning products, food, beverages, household goods and household appliances, adding up the overall estimated value indicated.

Each specific contract within the DPS will have its own tender, where unit prices, technical characteristics and maximum delivery times will be fixed; the price will be the result of the best offer, including all costs and taxes broken down.
As regards award criteria and weightings, the specifications state that the ordinary criterion will be the lowest price, with inversely proportional valuation formulas.
As indicated in “Option A”, the lowest bid receives 100 points and the others are valued by Vi = (Omin/Oi)*100.
In “Option B”, the price is weighted with a maximum of 70 points and other objective criteria (economic or qualitative) are allowed automatically assessable up to 30 points, detailed in each invitation.
For tiebreakers, the preference for companies with equal opportunities measures between women and men is included in some parts of the specification; in other sections, the highest number and percentage of workers with disabilities in the workforce is mentioned as a tiebreaker criterion, which is a small contradiction between language versions or documents, although the general rule is that the provisions of the main administrative specifications themselves prevail.
The treatment of abnormally low tenders is also regulated in accordance with Article 149 LCSP and the RGLCAP, with percentage thresholds according to the number of tenderers.
On risks and special conditions, the text introduces numerous contractual obligations.
Such as: special social (ensure occupational safety and health, implementation of collective agreements, compliance with commitments valued as award criteria, and subcontracting rules) and environmental (minimize and properly manage waste) performance conditions.
Tax transparency is required, prohibiting relations with tax havens and requiring full declaration of income and profits.
At the labour level, the contractor and the subcontracting chain must apply the corresponding sectoral agreement and pay wages in accordance with the law; these obligations are considered essential.
Invoicing must be done electronically via FACe, with DIR3 codes indicated and file reference; taxes, fees and tender costs are borne by the successful tenderer.
No final guarantee is required for specific contracts as they are worth less than €15 000; there is no need to revise prices.
The risks of non-compliance materialise in a detailed penalty regime: for delay (€ 4/€ 1 000 per day), for defective or incomplete performance, for breach of special performance conditions, for breach of award criteria assumed in the tender (considered very serious if they alter the result of the award), for breaches in subcontracting or late payment with subcontractors (percentage penalties that can reach up to 50% of the amount of the subcontract or a legal maximum of 10% of the contract price, and that in case of repetition can lead to contractual termination).
In addition, there are rules on assignment of the contract, subcontracting, protection of personal data (GDPR), special recourse limited to the first phase of establishment of the DPS and transparency obligations.
As regards the procedure, deadlines and possible contradictions or corrections, the specifications state that initial requests to participate are submitted electronically via the Public Sector Procurement Platform within 30 days of the announcement, in a single envelope/file with administrative documentation; applications are secret and it is prohibited to submit more than one tender or to participate simultaneously in a joint venture and an individual tender.
For each specific call for tenders, the contracting authority invites electronically all tenderers admitted to the relevant category, with a minimum period of 10 days to submit tenders (reducible to five under urgent procedure) and without the possibility of submitting more than one tender.
Specific contracts are not concluded; are perfected with the award.
The Contracting Bureau has ten working days to assess requests to participate and may provisionally admit tenderers with formal defects (e.g. expired electronic certificates), applying an anti-formalist principle and requiring rectification within five working days.
As it appears in the included minutes, category assignment and electronic signature errors have been corrected, making it clear that if a category is not included in the specific file, accession must be processed in the correct DPS.
