Dynamic Purchasing System for Individual Electric Mobility Equipment – LYMA Getafe (EXP34.2025)

The input text concerns a Spanish public procurement procedure launched by Limpieza y Medio Ambiente de Getafe S.A.M.

(LYMA), a municipal company in Getafe, Spain.

It sets up a Sistema Dinámico de Adquisición (Dynamic Purchasing System, SDA) for the supply of individual electric mobility equipment (CPV 34144900 – electric vehicles).

The perspective and legal framework are clearly Spanish (Ley 9/2017 de Contratos del Sector Público, Tribunal Administrativo de Contratación Pública de la Comunidad de Madrid), with publication in the EU’s TED (DOUE) but all substantive rules and decisions are from Spanish authorities.

As background, the SDA EXP34.2025 is defined as a supply contract, processed under the restricted procedure and ordinary (standard) processing.

The Memoria Justificativa explains that LYMA needs to homologate suppliers for electric mobility equipment, including spare parts, accessories and pieces, due to the upcoming end of an existing contract and the continuing need for such equipment.

The system’s estimated value is 99,000 EUR (without VAT), with a planned duration of ten years from the first homologation, and an overall execution period indicated from 10/03/2025 to 09/03/2035.

The SDA is governed by a Cuadro de Características Particulares (CCP) and a Technical Specification document approved by the contracting authority.

Regarding what bidders must submit and minimum qualification requirements, the text states that participation is limited to economic operators that demonstrate capacity to act (Capacidad de obrar) via the DEUC/ESPD, following CCP’s cuadro 7.1.

As such, bidders must submit documentation administrativa in a single envelope (sobre único) as described in point 7.1 CCP, including the DEUC and evidence that they are up to date with social security contributions.

For solvency, they must provide: (a) economic/financial solvency—volume of annual business over the best of the last three years of at least 50% of the average annual estimated contract value, verified via a responsible declaration (individuals) or approved and filed annual accounts (companies); and (b) technical/professional solvency—a list of contracts of similar nature over the past three years whose amount reaches 50% of the average annual estimated value, accredited by invoices, contracts or certificates of good execution.

For newly created companies, a civil liability insurance covering possible contractual breaches for the amount required as economic solvency is required.

Inscription in the ROLECE is expressly not demanded (box “No” is ticked on the basis that it would limit competition under art. 159 LCSP).

For contract-specific tenders (e.g.

Específico 1 and Específico 2) bidders must also submit Anexo I and technical datasheets (fichas técnicas), and offers must include electronic catalogues, as indicated in the tender conditions.

Concerning the scope of the contract—what, how much, where, when—the SDA’s object is the supply of individual electric mobility equipment (vehicles and related parts) for LYMA, coded under CPV 34144900.

The estimated total value is 99,000 EUR, also serving as the base budget of the tender.

The general execution period is from 10/03/2025 to 09/03/2035, linked to the system’s validity until 09/03/2035 at 23:59, with the initial duration from the first homologation and a total of ten years.

Place of performance is Getafe (Madrid), specifically Calle Helena Rubinstein, nº 6, Polígono Industrial El Lomo (28906), with LYMA’s contracting support address mentioned as Plaza de Chamberí, 8, 5ª planta, Madrid for certain notices.

The procedure is restricted, with a minimum of five candidates to be invited as per the pliegos, and the offers reception deadline for participation requests is 07/03/2025 at 23:59, with the administrative envelope opening scheduled on 10/03/2025 at 07:00.

The period of validity of the dynamic system and the contract execution are aligned to 09/03/2035.

Contract-based specific awards (e.g.

On award criteria and weighting, the SDA framework indicates that contract-based awards will be made on the basis of price/cost and possible additional quality-related criteria, with exact percentages to be specified in each based contract.

The general CCP states that “Precios de las prestaciones” will be valued alongside any subjective or objective criteria LYMA may set in each based contract, and that “Otros criterios referentes a la calidad técnica” (such as quality of materials, execution, post-sales service and guarantees) can be evaluated as specified per contract.

In the notices on the PCSP, award conditions are described as “Criterios evaluables mediante aplicación de fórmulas” with a single “Otros” criterion having a weighting of 100, effectively meaning that the award is formula-based, likely on price plus delivery time.

Concrete examples are given in Específico 1 and Específico 2: such as for Específico 1, TROMBER DEVELOPMENT and TEDITRONIC compete and are scored on “Oferta económica” and “Plazo de entrega” resulting in total scores (e.g. 75 points for price + 13 for delivery for TROMBER, totaling 88).

Similarly, for Específico 2, FENIKS CLEANING & SAFETY and SURTRUCK are scored with price contributing 85 vs 84.06 points, delivery time 15 points in both cases, totaling 100 vs 99.06.

In all cases the highest total score obtains the contract, illustrating that price is dominant with a fixed maximum weighting of 100 points and delivery time providing a supplementary share within that formula.

On risks and special conditions, the CCP introduces several binding obligations and penalties.

As such, there are special execution conditions of a social and environmental nature: contractors must comply with at least one social and one environmental measure chosen from detailed lists (e.g. actions on equality between women and men, anti-harassment measures, conciliation of work and personal life, support for disabled or at-risk persons; and environmental actions such as minimizing use of resources, reducing waste and greenhouse gas emissions, using renewable energy, using ecological products, recycling and reuse systems, maintaining environmental values, sustainable water management, etc.).

Non-compliance with these special execution conditions constitutes a serious breach, allowing LYMA either to resolve the contract or to impose penalties up to 10% of the contract price (excluding VAT), in line with article 202.3 LCSP.

The contractor must annually send documentation proving compliance to the Contract Responsible.

Regarding guarantees/insurance, for contract-based awards the CCP notes a civil liability insurance condition: although the matrix form shows “Seguro de responsabilidad civil SÍ … ☒ NO,” the operative text states that insurance must cover professional risks at least at 100,000 EUR and equal to or above twice the estimated contract value per year/sinister, especially for new companies, making this a de facto obligatory condition in based contracts where it is invoked.

Penalties are also specified for behavioural risks in the SDA: failure to participate (not submitting offers or submitting defective offers that cannot be admitted) can result in suspension from the system for 2–4 months; defective execution leading to culpable contract resolution can also cause suspension from the SDA for 2–4 months; delays in execution incur a penalty of 3% of the based contract per day of delay.

Payment terms for contracts based are partial payments, following delivery and acceptance of the goods.

Subcontracting rules are not explicitly detailed in the provided text, implying that standard LCSP rules apply.

Question deadlines and site visits are not described explicitly; the notices point to a single contact email ([email protected]) and define the act of offer opening as “privado”; no obligatory site visit is mentioned.

About contradictions or corrections in the documents, the text contains some clarifications and formal corrections.

For example, the general tender announcement in the DOUE initially stated a sending date of 05/02/2025 which is corrected via a later notice to 06/02/2025; the clarifying note in 01-placsp-4 and 12-placsp-19 explains that where it previously said “05/02/2025” it now says “06/02/2025” and that further information is added in an annex with the TED link.

Additionally, while the Memoria Justificativa refers to the procedure as “Restringido” and the approval of the expediente (06-placsp-13) refers to “Procedimiento Sistema Dinámico de Adquisición,” this is not a true contradiction but rather a distinction: the SDA itself is established using the restricted procedure but within that framework contracts are awarded via the dynamic system regulated by articles 223 et seq LCSP.

The authoritative statements are those in the later, approved CCP and clarifying notes, and where multiple versions of homologated supplier lists appear, the most recent Nota Aclaratoria (e.g. including FENIKS CLEANING & SAFETY and SURTRUCK) prevails, making the final homologated list eight suppliers as enumerated in 10-placsp-17.
