Sistema Dinámico de Adquisición para el suministro de impresos del Ayuntamiento de Alcobendas
The input text concerns the establishment and operation of a Sistema Dinámico de Adquisición (SDA) for the recurring supply of printed materials (“impresos”) to the Ayuntamiento de Alcobendas, in Spain.
It is drafted from the Spanish public authority’s point of view, applying Spanish national legislation (Ley 9/2017 de Contratos del Sector Público, LCSP, Ley 39/2015, etc.) and references to EU law (publication in the Official Journal and EU data protection rules).
The contract documentation defines how companies can join the SDA, under what conditions specific supply contracts will be tendered and awarded, and which administrative and technical rules govern execution, penalties and guarantees.
Such as in the description of the SDA’s object and scope, the documents explain that it is a fully electronic, restricted procedure-based system for “Impresos varios” (CPV 22900000).
The SDA covers the recurrent supply of various printed models for municipal administrative activity and citizen attention.
The estimated value of the SDA is 118,000 EUR (60,000 EUR base for 3 years + 40,000 EUR for up to 2 annual extensions + 12,000 EUR for possible 20 % modifications + 6,000 EUR for up to 10 % increase in quantities).
The SDA itself has a duration of 3 years, with the possibility of up to 2 additional one‑year extensions (maximum 5 years in total).
Each specific contract under the SDA may have a maximum duration of 18 months.
The place of performance is Alcobendas (Madrid, ES300, Spain), and contracts are processed entirely via electronic ordering, invoicing and payment.
Such as in the requirements for participation and what bidders must submit, the text states that any entrepreneur may request to join the SDA throughout its validity, following LCSP arts. 223–225.
Capacity to contract, absence of prohibitions, and compliance with tax and social security obligations must be accredited as per Clause 11 of the PCAP (e.g. certificates from Agencia Tributaria and Seguridad Social, powers of representation).

Economical solvency is based on annual business volume in the SDA’s field: a minimum annual turnover not exceeding 60,000 EUR, documented by a responsible declaration covering the last up to three years (with special rules for newly created companies under art. 75 LCSP).
Technical/professional solvency requires a list of main similar supplies over, at most, the last three years, with amounts, dates and clients, and a minimum value of 70 % of the average annual volume, fixed at 56,000 EUR.
This can be evidenced by certificates from competent bodies or, failing that, a responsible declaration with supporting documents.
There is also a commitment requirement to assign sufficient personal and material means to the SDA’s execution.
Examples of businesses declined from adhesion show practical application of these rules (e.g. rejection for lacking technical and economic solvency or pending proof of tax/social security compliance).
Such as in the award criteria and weighting, the SDA documentation indicates that specific contracts will be awarded to the bidder presenting the best offer according to criteria previously announced and later detailed in each invitation (art. 226.4 LCSP).
The general criteria for all categories are: (1) offer price (economic) with a weighting range of minimum 50 points, maximum 90 points; (2) delivery time for the supply, weighted between 10 and 40 points; and (3) quality/improvements and adaptation to the technical specifications, weighted between 0 and 50 points.
The Platform entry further refines this into formula-based criteria with defined minimum and maximum scores (e.g. price, delivery time, and quality as separate evaluable criteria).
These ranges allow the contracting authority to tailor the exact formulas and point allocation in each specific tender while remaining within the announced bands.
Such as in the identified risks, penalties, guarantees and subcontracting rules, the SDA sets out that no provisional guarantee is required, and no general definitive guarantee is demanded just to join the SDA.
However, for specific contracts, the invitation may require a definitive guarantee equal to 5 % of the contract award amount (excluding VAT), especially where appropriate for consumable goods deliveries under art. 107.2 LCSP.
There is a detailed regime of special execution conditions, notably the environmental requirement that packaging must have minimal ecological impact, proven by labelling and a signed declaration at the start of each specific contract; non-compliance with this is classified as a grave breach.
Penalties are structured as general limits (no more than 10 % of the SDA price per penalty, nor more than 50 % total) and specific monetary percentages for each breach category: mild infringements 2 % of the specific contract price, up to 2 % of the SDA; grave infringements 5 %, up to 5 %; very grave infringements 10 %, up to 10 %.
Mild, grave and very grave infringements are defined both in general SDA terms (e.g. failures to supply on time, technical condition breaches, secrecy breaches, non‑compliance with environmental and data protection obligations) and in more operational terms (e.g. delays in submitting documentation, faults in billing, repeated defects in information delivery, improper staff incidents, manifestly defective supply).
Commission of two very grave breaches can lead to termination of the SDA for the contractor, with possible confiscation of any guarantees and a duty to indemnify damages.
Subcontracting is permitted under art. 215 LCSP, but bidders must state in their offer the part to be subcontracted, its value, and the subcontractor’s name or profile based on their solvency conditions.
Such as in the contradictions or corrections within the documents, the text shows parallel and overlapping descriptions rather than outright conflicts.
For example, the SDA duration is consistently set at 3 years plus up to 2 annual extensions (maximum 5 years) across the technical necessity report, the legal report and the Platform notice.
Penalty levels and breach classifications appear twice, once in a more general SDA context and once in a more operational context, but the numeric ranges (2 %, 5 %, 10 %) and the link to art. 192 and 194 LCSP coincide; where there are dual classifications (e.g. secrecy breach or defective supply as grave or very grave), the documents themselves resolve this by referring to art. 29.3 LRJSP criteria and by stating that the “very grave” qualification applies when obligations are essential (e.g.
EU/Spanish data protection compliance under art. 211 LCSP).
