Dynamic Purchasing System for Laboratory Chemicals and Consumables in Spain
The input text concerns the establishment of a Sistema Dinámico de Adquisición (SDA) for the “Suministro de reactivos químicos y material fungible” for EGEVASA (Empresa General Valenciana del Agua S.A.) in Spain.
It is a procurement procedure under EU Directive 2014/25/EU for special sectors (water) and is published in the Spanish Plataforma de Contratación del Sector Público and in the EU’s TED.
The entire perspective is Spanish: the contracting authority, legal references (LCSP, Real Decreto 3/2020), addresses (Valencia, Madrid), and the activity (water services and laboratories) are all within Spain.
As background, the SDA is set up to cover fluctuating needs for laboratory chemicals and consumables used in water quality and wastewater analysis.
Such as described in the “Informe de necesidad”, EGEVASA’s laboratory must comply with national, regional and EU environmental and water regulations, requiring continuous analytical capacity.
Because demand and types of analysis vary with seasonality, new contaminants and methodologies, the authority opts for a dynamic purchasing system rather than a fixed long‑term contract, allowing ongoing admission of suppliers and subsequent specific contracts.
Regarding what the bidder must submit and the minimum qualification requirements, the text specifies solvency and participation conditions both in generic references to the PCAP (Pliego de Condiciones Administrativas Particulares) and in Annex II of the need report.
Such as, bidders must provide documentation for adhesion to the SDA in a single electronic envelope via PLACSP; demonstrate economic‑financial solvency (annual turnover at least 1.5 times the annual estimated value of the category, positive net equity, supported by accounts, profit-and-loss statements and responsible declarations); and technical‑professional solvency (list of similar supply contracts within the last three years for the relevant CPV codes, with amounts, dates and clients, reaching at least 70% of the annual estimated value of the category).
Certificates of quality, environmental and health-and-safety management are explicitly marked “NO APLICA”, and references to “Conforme Anexo V del PCAP” indicate that detailed forms and any additional requirements are in that annex, not fully reproduced in the input.
Concerning the scope of the contract (what, how much, where, when), the SDA covers two categories: Category 1 (reactivos químicos y patrones de referencia) and Category 2 (material de laboratorio y fungible, including glassware, plastics, kits, instruments).
The total estimated value is 750,000 EUR (500,000 EUR for Category 1 and 250,000 EUR for Category 2), with a total budget including VAT of 907,500 EUR.
Place of performance is Spain, for EGEVASA’s laboratory operations.

The execution period of the SDA is 5 years from 18/02/2026 to 18/02/2031, with no prórrogas (extensions) indicated for the SDA itself in the published notice, though the need report contains a template mentioning possible prorogations for specific contracts but leaving them blank.
The dynamic system is open for participation requests until 20/03/2026.
Award criteria and weighting are described both for joining the SDA and for subsequent specific contracts.
For adhesion, the criteria relate to solvency and capacity rather than scoring.
For specific contracts, Annex III sets basic rules: such as, Option 1 combines up to 40 points for criteria assessed by judgment of value and 60–100 points for automatic criteria (typically price), potentially with a minimum threshold for qualitative criteria up to 20 points; Option 2 allows up to 100 points solely for automatic criteria.
In the PLACSP summary, price appears as a formula‑based criterion with 60% weighting under Option 1, and “Otros” as automatic criteria with 100% weighting under Option 2, plus up to 40% for “Otros” under judgment of value.
The exact configuration to be used for each specific contract will be defined in the individual invitations.
As to risks and special conditions, the documents highlight guarantees, subcontracting, execution conditions, electronic procedures and payment terms.
Such as, no provisional guarantee is generally required to participate in the SDA, although the template allows the authority to require one in specific instances.
For definitive guarantees in specific contracts, the authority may require (if stated in the invitation) a 5% guarantee of the maximum contract amount (excluding VAT), in cash, bond or surety, with a guarantee period equal to the contract duration plus one month.
Subcontracting is permitted in principle, with the alternative that certain critical tasks could be excluded or only transport subcontracting allowed, but the definitive rule is in the pliegos (Annex IV notes “NO APLICA” for mandatory means and then lists special execution conditions on transport, safety, environment and proper classification/labeling/packaging of chemicals).
There are no explicit penalty clauses in the excerpt, but the risk profile includes compliance with transport and hazardous substances regulations, the absence of minimum volume commitments (the authority only pays for actual orders within a maximum price framework), and the need to issue electronic orders and invoices with electronic payment accepted.
The system’s validity period and deadlines (SDA up to 18/02/2031, participation requests to 20/03/2026) are clearly defined, but there is no mention of mandatory site visits or question deadlines beyond “Información adicional” via the contracting unit and the generic reference that appeals deadlines and procedures follow the PCAP.
On contradictions or corrections within the documents, the input shows standard internal templates alongside final chosen options, which can appear inconsistent if read literally.
Such as, the “Informe de necesidad” template lists multiple possible procedures (abierto, abierto simplificado, super simplificado, restringido, etc.), but later clarifies that for SDA the chosen procedure is “RESTRINGIDO” in accordance with article 224 LCSP and RD 3/2020; this is corroborated by the published announcement and pliego documentation, which explicitly state “Procedimiento Restringido”.
Similarly, the template mentions that for supplies under 35,000 EUR solvency would not be required, but Annex II sets explicit solvency thresholds based on the SDA’s higher estimated value; thus, the operative rule is that solvency requirements do apply as described in Annex II and the PCAP.
Where template alternatives for guarantees and subcontracting are left with blanks or multiple options, the operative statements are those concretely reflected in the PCAP and in the PLACSP notice (no provisional guarantee as general rule, possible 5% definitive guarantee if requested; subcontracting allowed, with special execution conditions).
In case of any residual conflict, the hierarchically superior and more specific documents (PCAP, PPT and the published restricted procedure notice) would prevail over generic template clauses in the need report.
