Establishment of a Dynamic Supply Acquisition System for the City of Galapagar

The text deals with the tendering and subsequent operation of a Dynamic Procurement System (SDA) of several supplies promoted by the City Council of Galapagar, in the Community of Madrid (Spain).

The previous announcement, the specifications, the conditions of participation, the documentation required of the companies and several derived purchases (office chairs, outdoor bins, software licenses, folios) are described, all from the point of view of the Spanish public administration (references to Law 9/2017 on Public Sector Contracts and the state platform PLACSP).

As for what the text says about what the tenderer must submit and the minimum participation requirements, numerous documentary requirements linked to the DPS 10/2025 and subsequent invitations are detailed.

For example, several annexes are required: Annex I (Application for Membership/participation in the DPS), Annex II (Responsible declaration of non-prohibition to contract), Annex III (Model economic offer for derived purchases) and Annex IV (Joint Venture Commitment).

In addition, documents are mentioned such as power of attorney, company CIF, applicant’s ID, certificate from the AEAT (Hacienda), Social Security certificate, and an ‘Affidavit not to be subject to incompatibilities’ (model of responsible declaration included in the documentation).

With regard to solvency, technical and professional solvency is required (for example, list of the main similar supplies made in the last three years with amount, date and recipient) and economic and financial solvency (figure of annual turnover attested by annual accounts deposited in the Commercial Registry or equivalent official registry).

In the tables of companies presented, it is seen that, when documents are missing, correction is required (for example, providing annual accounts, updated certificates of Finance and Social Security, work relationships, etc.).

On the scope of the contract – what, how much, where and when – the text indicates that the general purpose is the “Procurement of necessary supplies demanded by the Municipality of Galapagar” through a DPS (Expte. 10/2025).

An estimated value of EUR 29 000 000 and a base tender budget of EUR 5 800 000 without taxes (EUR 6 909 100 with VAT), with a deadline for implementation from 28/02/2025 to 26/02/2030, and place of execution in the municipality of Galapagar (Comunidad de Madrid, code ES3), are set.

Multiple CPV product categories are listed (agriculture, energy, food, clothing, office and computer equipment, electrical equipment, communications, medical equipment, transportation, security, furniture, construction, software, transportation services, etc.).

In addition, specific derived purchases are described: e.g. purchase of 60 packages of DIN A4 folios and 20 packages of DIN A3 folios with a tender price of €358 excluding VAT; purchase of 7 chairs for normal office use and 1 chair for intensive use; purchase of 40 outdoor metal bins; purchase of 3 Creative Cloud Pro licenses, 8 Acrobat Pro licenses and 5 Autodesk AutoCAD LT licenses.

In all these derived purchases, the delivery time of the material is set at 7 days from the day following the notification of the agreement, in accordance with clause 18.8 of the PCAP and point 9 of the invitation.

Regarding the award criteria and their weighting, the text shows both the logic of the DPS and concrete examples.

In the dynamic system, companies are approved by categories after accrediting documentation and solvency, and then are invited to derivative purchases in those categories.

In derived purchases, the main criterion is price, with economic scores calculated on the basis of the cancellation of tenders (for example, in the acquisition of folios: LINEA PAPEL’s bid for €322 compared to COPYCOP’s €333, with tender reductions of 10.06 % and 6.98 %, resulting in scores of 100.00 and 96.70 points respectively).

In other cases, such as purchases of office chairs or software licenses, only one offer is submitted and 100 points are assigned to it, as it is unique and meets the award criteria.

Although the text does not detail complete formulas or weightings between price and other criteria, it appears that the price (supply point) is the determining criterion and that “improvements” could have weight, although in the tables examined they appear without numerical values.

In relation to risks and special conditions, the text provides some references but without developing specific penalty clauses.

Acceptance of e-invoicing is mentioned as a condition of execution.

The ‘Guarantee Model’ is also cited as Annex VI in the specifications, which indicates the possible requirement for guarantees, although the fragments do not specify amounts or types of guarantee or penalties.

There is no explicit reference to penalties for delays or to the subcontracting regime in the extracts, although by application of Law 9/2017 it could be that they were in the complete PCAP.

The text does set strict deadlines: 10 days to send proposals after invitation in the case of folios; 3 working days to correct documentary defects in accordance with the table in the minutes; 7 days for delivery of supplies after notification of the award.

There is no mention of visits to facilities or specific deadlines for questions from tenderers, or periods of validity of tenders, although it can be understood that they are governed by the provisions of the administrative specifications (PCAP) and invitations, not reproduced in full here.

Finally, regarding contradictions or corrections within the documents, the text includes several “links to the previous announcement” where official amendments are made, indicating which wording prevails.

For example, in a notice the date “28/12/2029” is corrected and replaced by “23/05/2025”; the words “About 1” now read “1 Call”; Additional information on the preparation of the tender (Administrative Accession Documentation, CPV included, etc.) is added.

It is also stated that CPV classification 03110000 (Cultivation, commercial gardening and horticulture products) is added to the DPS notices.

These amendment notes with time stamp FNMT-RCM indicate that the corrected versions of the notice and the specifications are the ones that apply.

Likewise, the minutes of the recruitment table indicate provisional exclusions of companies or requirements to rectify when the request to participate does not coincide with the CPV of the requested categories (for example, CARPIL, S.A., or JOMICON 99, S.L. and others), making it clear that consistency between the CPV category, the solvency provided and the application for membership prevails, and that, until the companies correct their admission, they are in a provisional situation.
