Sistema dinámico de adquisición para la recogida y gestión de residuos peligrosos en Getafe (EXP29.2025)

The input text concerns the establishment and operation of a “Sistema Dinámico de Adquisición” (dynamic purchasing system, SDA) by LIMPIEZA Y MEDIO AMBIENTE DE GETAFE S.A.M.

(LYMA) for the collection and management of hazardous waste in the municipality of Getafe.

It is clearly within the Spanish public procurement framework (Ley 9/2017 de Contratos del Sector Público, LCSP) and references both national bodies (Tribunal Administrativo de Contratación Pública de la Comunidad de Madrid) and EU publication via TED.

The perspective is therefore that of a Spanish contracting authority operating under EU and Spanish procurement rules.

Such as background, the SDA EXP29.2025 is justified through a “Memoria justificativa” explaining the need to continue hazardous waste removal services after expiry of a previous contract, and the lack of internal technical means (art. 30.3 LCSP).

The SDA is a service contract, with CPV 90500000 (services related to waste and refuse), valued at an estimated 90,000 EUR (without VAT), with a duration of 10 years from the date of first homologation (and operational period from 27/02/2025 to 26/02/2035).

It is set up via a restricted procedure with ordinary processing, and requires publication in the Plataforma de Contratación and DOUE (TED notice 58532-2025, publication 28/01/2025 after a correction of the date).

Regarding what the bidder must submit and minimum qualification requirements, the text indicates that participation requires general capacity to act evidenced through the DEUC (ESPД) in accordance with point 7.1 of the CCP and the link to the ESPD web.

Motives for exclusion include non‑payment of social security contributions, as determined in the CCP.

Solvency economic‑financial criteria, such as the bidder’s annual turnover in the best of the last three years, must reach at least 50 % of the estimated average annual value of the contract; individuals evidence this via responsible declaration, legal entities via approved and filed annual accounts; new companies may use a professional liability insurance policy equivalent to the required economic solvency.

Technical‑professional solvency requires a list of contracts over the last three years of equal or similar nature comprising at least 50 % of the estimated average annual contract value, supported by invoices, contracts or certificates of proper performance; new companies must evidence the allocation of adequate means prior to award.

There is no obligation to be registered in ROLECE, explicitly because it would limit competition in this sector (art. 159.4.a LCSP), and no specific professional licence requirement applies.

Additionally, the system’s characteristics require submission of a single envelope with administrative documentation and catalogues in electronic format for offers, and bidders must also submit proof of appropriate civil liability insurance (minimum policy limit 50,000 EUR; in another passage, cover for professional risks equal to twice the estimated contract value per claim/year is mentioned, creating a potential inconsistency that must be read together as the stricter CCP requirement).

Concerning the scope of the contract—what, how much, where, when—the SDA’s object is described consistently as “Contratación de servicio de retirada de residuos peligrosos en el término municipal de Getafe” and “Establecimiento de sistema dinámico de adquisición para el servicio de retirada de residuos peligrosos en el término municipal de Getafe”.

The place of performance is Getafe (Madrid), specifically CALLE HELENA RUBINSTEIN Nº 6, Polígono Industrial El Lomo (28906) and the municipality at large for collection activities.

Quantities are not fully detailed in the excerpts, but the total estimated value is 90,000 EUR, with a base tender budget equal to that amount.

The SDA vigencia runs until 26/02/2035, with requests to participate accepted until 26/02/2025 at 23:59, and administrative envelope opening scheduled for 27/02/2025 at 08:00.

On award criteria and weighting, the SDA framework defines two broad groups of criteria for the contracts based: price/cost of the prestations, and other quality‑related criteria.

Such as for price, the form of evaluation is the price or cost of the services plus any other objective or subjective criteria LYMA may decide for each based contract; each contract will fix the exact weighting, but price will account for between 0 % and 50 % of total points.

Other technical quality criteria (for example, quality of materials used, execution quality, post‑sale service or guarantees) also receive between 0 % and 50 % of the scoring depending on the specific based contract.

For the SDA establishment itself, the PCSP entry shows a generic evaluation criterion “Otros” with 100 % weighting, configured solely to satisfy platform requirements; the detailed scoring structure is actually deferred to the CCP and each based contract.

This flexibility is typical of dynamic purchasing systems, where admission (homologation) is largely pass/fail on solvency and capability, and competition on price/quality takes place at the level of each call‑off.

Risks and special conditions are dealt with both for the SDA and the contracts based.

Such as special execution conditions, at least one social and one environmental condition must be chosen and complied with by the contractor; these are declared to be essential contractual obligations and non‑compliance is a serious breach potentially leading to termination or penalties up to 10 % of contract price (art. 202.3 LCSP).

Social measures may include, for example, training and awareness for staff, equality promotion, anti‑harassment actions, work–life balance measures, employment of persons with disabilities or at risk of exclusion, and support for childcare.

Environmental measures may include minimising consumption of natural resources, reducing hazardous/non‑hazardous waste generation, promoting energy efficiency and renewable energy, complying with eco‑labels, using ecological and seasonal products, reducing greenhouse gas and pollutant emissions, minimising discharges of priority substances in water, reducing use of CMR substances, using recycled and biodegradable materials, maintaining environmental values, sustainable water management, use of renewable energies, reusable packaging, recycled material, systems for reuse/recycling, and availability of an environmental vehicle fleet.

Penalties specified in the CCP for SDA operation include: suspension from participation in the SDA for 2–4 months if a provider repeatedly fails to submit offers to based contracts or submits defective offers; suspension for 2–4 months if a based contract is defectively executed leading to culpable termination; and a daily delay penalty of 3 % of the value of the based contract.

Payment terms foresee, as a rule, a single payment after full delivery and acceptance of all services, with possible aggregation of partial deliveries into a single payment.

The system uses electronic ordering, but not electronic invoicing or payment, and there is no mention of subcontracting limitations or mandatory guarantees beyond the civil liability insurance.

Concerning contradictions or corrections, there are a few noteworthy points.

Such as procedural description, the “Memoria justificativa” and the initiation agreement describe the procedure as “restringido” (restricted), whereas the approval of the expediente specifies “Procedimiento: Sistema Dinámico de Adquisición”; in practice, this means that the SDA is established via a restricted procedure, after which the SDA itself governs future based contracts, so both statements are complementary rather than conflicting.

The TED notice correction explicitly changes the DOUE publication date from 27/01/2025 to 28/01/2025 and adds annex information; the corrected publication details in the PCSP must be considered the valid ones.

Another apparent tension concerns ROLECE: the CCP text includes a general clause about possible ROLECE registration but then clearly marks the box “No” on the basis that ROLECE would limit competition for this SDA, meaning that no registration is required and this specific statement prevails.

For civil liability insurance, a minimum policy limit of 50,000 EUR is mentioned on one page, while another line requires insurance equal to twice the estimated contract value per claim/year; given procurement practice, the requirement “igual o superior a dos veces el valor estimado del contrato” is the stricter and more specific solvency condition and should be treated as prevailing for admission.

Finally, although MANUFACTURAS RECICLAUTO is excluded from a specific based contract (BO25/00007) for breaching maximum unit price, the homologation resolutions confirm that this company remains an admitted provider within the SDA along with other firms (Higiénica de Biosanitarios, SRCL Consenur, Servicios Integrales Sanitarios Madrid, Sertego and Ambar Plus); the exclusion therefore applies only to that particular call‑off and not to the overall SDA.
