Dynamic Purchasing System for Chemical Supply – EGEVASA (EC-1740/2026)

The input text concerns the establishment and operation of a Sistema Dinámico de Adquisición (SDA, Dynamic Purchasing System) for the supply of chemical products to Empresa General Valenciana del Agua S.A.

(EGEVASA), a public entity under local authority control in Spain.

The country point of view is clearly Spanish, with references to Spanish public procurement law (Ley 9/2017 LCSP and RDL 3/2020) and to the EU procurement framework (Directive 2014/24/EU).

The place of performance is Valencia/València, Spain (codes ES and ES523), and the contracting authority is located in Valencia.

As background, the SDA is set up under a restricted procedure, as required by LCSP and RDL 3/2020 for dynamic purchasing systems.

The announcement was sent to the Official Journal of the EU on 27/03/2026 and published on the Plataforma de Contratación del Sector Público and in the contracting authority’s profile around 29–30/03/2026.

The SDA covers “suministro de producto químico” (chemical supply) of use corriente, with characteristics generally available on the market, for EGEVASA’s water-related installations.

The period of validity of the SDA runs from 27/04/2026 to 27/04/2031, and new economic operators may request admission throughout this period.

Concerning what the bidder must submit and the minimum qualification/solvency requirements, the text repeatedly refers to Article 12 of the PCAP (Pliego de Cláusulas Administrativas Particulares) and its Annex II.

In particular, bidders must submit (i.e. such as) documentation on capacity to act, compliance with social security and tax obligations, and absence of exclusion grounds, as per LCSP and the PCAP.

They must also provide: (a) evidence of economic and financial solvency – volume of annual business (cifra de negocios) in the best of the last three approved and filed financial years, at least 1.5 times the annual estimated value of the category they apply to, plus annual accounts and a positive net equity; and (b) evidence of technical/professional solvency – a list of supplies of similar nature within the last three years, for the relevant CPV codes, with accumulated amount at least 70% of the annual estimated value of the category, including contract object, amount, dates and client.

Classification certificates do not apply.

Additionally, bidders must commit mandatory means (Annex IV) by providing the CV of a “Jefe de guardia” with >5 years’ experience and ensuring a 24/7 assistance service.

Failure to submit the documentation described in Article 12 or to meet solvency (as happened to H2O Innovation Europe SLU and Adiego Hermanos S.A. for Category 2) leads to non-admission to the SDA for the relevant category.

Regarding the scope of the contract (what, how much, where, when), the SDA covers two categories: Category 1 (CPV 24300000 – basic inorganic and organic chemicals, further including soda caustic, chlorine, ferric chloride, polyaluminium chloride, sodium hypochlorite, phosphates and related products) and Category 2 (CPV 24962000 – water treatment chemicals).

The estimated value of the overall SDA is 4,298,959.70 EUR (VAT excluded), with a total budget base including VAT of 5,201,741.24 EUR.

As indicated (such as in Annex I), Category 1 has an estimated and tender amount of 3,298,959.70 EUR and Category 2 of 1,000,000.00 EUR (both VAT excluded).

These amounts result from multiplying current annual consumption volumes by expected unit prices for 2026 over the five‑year duration.

The SDA itself does not guarantee any minimum purchase; the only obligation of EGEVASA is to pay for products actually ordered under specific contracts at the unit prices offered.

On award criteria and weighting, the documents explain that adherence to the SDA is based on meeting habilitation, solvency and capacity criteria, not on competitive scoring.

For specific contracts within the SDA, Annex III sets basic rules: criteria may follow Option 1 (0–40 points for judgment-based criteria and 60–100 points for automatic, formula‑based criteria) or Option 2 (0–100 points automatic only).

When Option 1 is used, a minimum threshold for judgment-based criteria may be set, up to 20 points.

The notices (such as the ones listing CPV codes and “Condiciones de adjudicación”) clarify that automatic criteria are primarily price, with a typical weighting of 60 points for price and 40 points for “otros” (other qualitative aspects), or alternatively 100 points price‑only.

The exact criteria for each specific contract will be detailed in the invitation under the SDA.

There will be no electronic auction (subasta electrónica: no).

Concerning risks and special conditions (penalties, guarantees, subcontracting, validity, question deadlines, site visits), several aspects are defined.

Guarantees: no provisional guarantee is required to participate in the SDA; however, for specific contracts a definitive guarantee of 5% of the maximum contract award amount (excluding VAT) must be constituted if the contracting authority requests it in the invitation, in cash, bond or surety insurance.

The guarantee period equals the duration of the specific contract plus one month, after which it is returned upon technical approval.

Subcontracting: generally permitted in line with the pliegos, but the contractor cannot subcontract the supply itself except for transport of the product; where the contractor is a distributor, manufacturing may be by a third party but any change of manufacturer during the contract must be notified with supporting documentation.

Special execution conditions (such as those in Annex IV and environmental Annex VI) include: mandatory maintenance of the 24/7 assistance service and Jefe de guardia (non‑compliance is a “falta muy grave”); compliance with transport, traffic, road safety, waste and environmental regulations; compliance with chemical classification, labelling and packaging rules; and verification of payments to subcontractors under article 217 LCSP, with the contractor obliged to provide details and proof of timely payments.

Non‑compliance with these conditions is classified as a serious or very serious breach, subject to penalties as defined in the penalization clause (not reproduced in the excerpts).

The SDA uses electronic orders, electronic invoicing and electronic payments, and the system’s validity runs until 27/04/2031 with requests for participation accepted up to 27/04/2026 at 23:59 via PLACSP.

For example, the text about “Tramitación: Ordinaria / Urgente” contains template language, but the procedure is clearly “Ordinaria” (ordinary) and “restringido” per article 224 LCSP; references to “servicio por importe inferior a 35.000 € no se exigen criterios de solvencia” are generic template text and do not apply here, as Annex II explicitly sets solvency criteria for this SDA.

There is also a correction notice changing the place of execution from generic “España” and code “ES” to “Valencia/València” and ES523; the corrected version (Valencia/València, ES523) is the one that applies.

Similarly, options for open, negotiated, etc., appear in a template list, but the selected and therefore binding procedure is the restricted procedure.

Where applicants were initially listed as presenting requests for both categories and later partially or fully rejected (such as H2O Innovation Europe SLU and Adiego Hermanos S.A. for Category 2), the subsequent admission agreement, signed electronically and citing Article 13 PCAP, is the authoritative record of which bidders are actually admitted and for which categories.
