Tender for rental transformer station at Landesarchiv Schleswig-Holstein

The input text contains the German public procurement documentation for a construction-related contract “Trafostation zur Miete Landesarchiv SH” in Schleswig (Germany), run by Gebäudemanagement Schleswig-Holstein AöR under VOB/A.

It sets out the rules, forms and contractual conditions for a bidder to submit an offer for a temporary transformer station and associated works within the “Neubau Magazinerweiterung” project for the Landesarchiv.

The perspective is that of German public contracting authorities applying German procurement and contract rules (VOB/A, VOB/B).

Such as in the “Aufforderung zur Abgabe eines Angebots” (Form 211) and “Verzeichnis der im Vergabeverfahren vorzulegenden Unterlagen” (Form 216), the bidder must submit: the signed Angebotsschreiben (Form 213), the priced Leistungsverzeichnis (LV), and—depending on the situation—forms 233 (Nachunternehmerleistungen), 234 (Bietergemeinschaft), 235 (Leistungen/Kapazitäten anderer Unternehmen), 248 (Holzprodukte), and any Instandhaltungs‑Vertragsformulare.

Non‑prequalified companies must attach the “Eigenerklärung zur Eignung” (Form 124) with turnover for the last three years, a declaration of comparable services in the last five years and a commitment to later provide at least three detailed references and various certificates (tax, social funds, Berufsgenossenschaft, Freistellungsbescheinigung).

Prequalified firms can instead cite their PQ‑number.

All additional evidences listed under section 2 of Form 216 (references, staff numbers, registrations, tax/insurance clearances, product data sheets, Urkalkulation etc.) are only required “auf Verlangen” if the offer comes into closer consideration.

Such as described in the Bekanntmachung (Form 121), the scope is: within the Landesarchiv Schleswig (Prinzenpalais, PLZ 24837) a building within the extension site is fully demolished; because the existing transformer and NSHV lie in the demolition zone, a provisional NSHV inside the existing building must be erected and supply lines relocated.

The Landesarchiv’s low‑voltage supply is then provided via a temporary outdoor transformer station for the interim period.

Execution starts “innerhalb von 12 Werktagen nach Zugang der Aufforderung” (expected by 30.11.2026); the delivery of the transformer station must occur by March 2027, and the overall performance is to be completed in calendar week 1/2029.

The LV adds operational constraints such as working only during archive opening hours, mandatory German‑speaking site management permanently present, registration and ID of all workers, weekly coordination meetings, and responsibility for all protective and safety measures on site.

Such as in section 7 of Form 211 and the Bekanntmachung, the award criterion is primarily the price: “Zuschlagskriterium Preis”.

Show all 21 statements

The contracting authority calculates a “Wertungssumme” from the checked offer sum, taking into account price reductions, any offered Lohngleitklausel adjustment amount and any Instandhaltungsangebote.

There is a specific bonus rule for Werkstätten für Behinderte/Blindenwerkstätten: they receive a 15 % bonus in the price evaluation; if their offer is equally economical to another, they get the award, provided they prove their status with the offer.

No further qualitative award criteria or weightings are specified in the provided text; references and technical data serve only to prove suitability, not to score the award.

Such as in the Besondere Vertragsbedingungen (Form 214), risks and special conditions include strict contractual time limits with contractual penalties: for each working day of delay against agreed start, interim and completion dates, a contractual penalty (percent of net contract sum) applies, capped at an overall percentage of the contract sum.

For larger contracts (≥ 250,000 € net), a 5 % performance guarantee and a 3 % defects‑liability guarantee (based on the total of progress payments at acceptance) are required, in the form of standardised client guarantee forms.

The documents clarify that technically “gleichwertige” specifications are always permitted, that “Heißarbeiten” (welding, cutting, etc.) require individual written permits (“Erlaubnisschein”), and that mis‑calculations using “Mischkalkulationen” lead to exclusion.

Such as in the Data processing clause (Form 244), where electronic GAEB files are only “Arbeitsmittel”, contradictions are resolved by stating that the written long version of the Leistungsverzeichnis is “alleinverbindlich”.

The Angebotsschreiben (Form 213) confirms that any amendments issued by the contracting authority are part of the offer.

Where general templates (e.g. 214 on securities) provide alternative options (“Verzicht” vs. “Sicherheit zu leisten”), the marked or filled‑in choice in the project‑specific form for this tender governs.

References and certificates from your home country count fully across the EU — that is what European procurement law is for.
Too big for you alone? Consortium or reliance on capacity: a partner's references and turnover count (Art. 63 Dir. 2014/24) — cross-border too.

Tactics

This procedure allows 25 days between publication and deadline — typical in this country is 32 (median of 20,071 procedures). Much tighter than usual: the first week counts.

The deadline falls on a Monday — your last full working day is the Friday before. Have evidence and guarantees together by Thursday.

Foreign bidders

In Germany, 6,022 contracts went to foreign companies over the last 3 years (of 725,088 recorded awards) — mostly from Austria, Poland, Italy.

Measured from linked award data; foreign winners bidding through a local subsidiary count as domestic — the true share is higher.
