Clement What the numbers say about this buyer

  • In this sector the buyer awards roughly every 5 months (3 awards, most recently May 2024) — by that rhythm the next award was due around October 2024. The last award went to XIMVIAM, S.L.n = 3
  • 35% of this buyer's awards went to companies that had already won here before (125 awards since 2020, spread over 79 companies). That is well below the sector norm (55%) — this buyer switches suppliers more often than others.n = 125 awards since 2020
  • The median procedure drew just one bid (8 procedures with a bid count); 50% ended with a single bidder. Sector: median 3 bids.n = 8
  • The award came in at a median 90% of the estimated value (110 awards with both estimate and value) — pricing at the estimate is usually too high here. Sector: 79%.n = 110
  • 93% of the bids received came from small and medium-sized enterprises (9 procedures with a bid mix). Sector: 71%.n = 9

Contracte de subministrament i instal·lació de projectors LED al camp de futbol 11 de Sant Lluís

The input text concerns a public procurement procedure in Spain (Ajuntament de Sant Lluís, Illes Balears) for a supply contract with accessory installation works: substitution of existing floodlights/projectors by new LED luminaires for a municipal football pitch.

It is drafted under the Spanish Ley 9/2017 de Contratos del Sector Público, with references to Spanish technical and safety regulations (REBT, ITC-EA, UNE standards) and regional environmental law (Llei 3/2005 de protecció del medi nocturn de les Illes Balears, Reglament de protecció del medi nocturn de Menorca).

The point of view is that of a Spanish contracting authority setting out technical, administrative, safety and environmental conditions for bidders.

As background, the documents describe the project’s objective as the replacement of existing luminaires and justification of the luminance values achieved, including detailed technical prescriptions (such as cable characteristics, projector photometry, colour temperature limits, efficiency requirements).

They frame the contract legally as a “contracte de subministrament” whose main object is the acquisition of LED equipment, with installation, orientation, desmuntatge and commissioning treated as accessory operations.

The procedure chosen is an open simplified procedure (procediment obert simplificat ordinari), justified because the estimated value is below EU thresholds but above the minor-contract limit, and because the authority wants to be able to require a definitive guarantee.

Regarding what the bidder must submit and the minimum qualification requirements, the text specifies several elements.

Such as, for economic and financial solvency, the bidder must demonstrate a minimum annual turnover equal to 1.5 times the estimated contract value, i.e. 65.118,47 € in the best of the last three closed financial years (art. 87 LCSP).

For technical solvency, bidders must provide the technical data sheet (“fitxa tècnica”) of the proposed projector and a guarantee certificate, enabling verification of compliance with the technical specifications.

The installer must be authorized in low voltage (Baixa Tensió) according to ITC-BT-03; this habilitation is checked with the Direcció General de Política Industrial.

As an alternative way to prove solvency, companies may present an official empresarial classification certificate: Group I (electrical installations), Subgroup 1 (enllumenats, il·luminacions), Category 1 or A. The manufacturer of the luminaire must hold ISO 9001, ISO 14001, ISO 45001 and ISO 50001 certifications, and the photometric data must be validated under UNE 13032-1 and UNE 13032-4.

Although the detailed administrative forms are not reproduced in the excerpt, the tender configuration in the platform shows a single envelope (“sobre único”) combining administrative documentation and automatically quantifiable criteria.

Concerning the scope of the contract, the documents define what, how much, where and when.

Such as, the scope covers the supply and installation of LED projectors for the municipal “camp de futbol 11” in Sant Lluís, including desmuntatge of old equipment, mechanical mounting at approximately 18 m height on existing towers, electrical connection, precise orientation (including goniometric adjustment with laser tracer), and final photometric verification.

As for time, several references appear: the project memory states an execution period of 2 months from contract signature; the general technical conditions mention that works must start within 15 days of communication of the award and finish within the period indicated in the award notice.

Award criteria and weighting are described as purely price-based.

Such as, the tender configuration (in the electronic procurement system) shows: one envelope containing “Documentación administrativa y criterios cuantificables automáticamente” and a single award criterion “Precio”, with weighting 100.

The evaluation formula indicated is X = (precio licitación – oferta solicitante)/(precio licitación – oferta más baja), giving a normalized score between a minimum and maximum (the text lists “Cantidad mínima: 100 Cantidad máxima” but is partially truncated).

Supporting narrative in the contracting report explains that price is the only criterion because (i) the technical prescriptions are exhaustively and standardly defined ex ante, leaving no relevant qualitative variability between offers, and (ii) technical quality is contractually guaranteed via an external certification by an Organisme de Control Autoritzat (OCA) as a condition for reception and payment.

Risks and special conditions are discussed extensively, especially safety, guarantees and subcontracting.

Such as, there is a requirement to constitute a definitive guarantee of 5% of the award amount (excluding VAT), described both in the project memory (“garantia definitiva equivalent al 5%”) and in the contracting report (art. 107 LCSP).

The project specifies a 10-year product/equipment guarantee up to 90.000 operating hours, covering LED modules and drivers, with conditions on acceptable wear (0,3% per 1.000 h) and failure thresholds (5% of LEDs).

In contrast, the generic technical conditions chapter 5.5 speaks of a 12-month guarantee period for conservation and proper functioning of the “obres”, suggesting that the 10-year term is specific to the luminaires while the 12-month term applies to construction/installation aspects.

Subcontracting is explicitly prohibited: both the electronic tender configuration and the contracting report state that “no se permite la subcontratación”, justified under art. 75.4 LCSP because all installation tasks (supply, mechanical mounting at height, electrical connection, precision orientation) are defined as critical and must be executed entirely by the main contractor to avoid dilution of responsibilities and to minimize coordination and safety risks.

The safety and health basic study (Estudi Bàsic de Seguretat i Salut) elaborates on risk assessment (falls, electrical contacts, fires, glare), mandatory training records, emergency measures, and legal obligations under Ley 31/1995, RD 1627/1997, RD 39/1997, and older safety ordinances.

Penalties are not spelled out in the excerpts, but the emphasis on guarantees, photometric certification by OCA, and measurement-based payment suggests that failure to achieve required light levels or environmental constraints would affect reception and payment rather than through separate penalty clauses; the risk of “dilució de responsabilitats” is explicitly mentioned to justify both non-division into lots and non-subcontracting.

Such as, on the nature of the contract and procedure, all sources are consistent: it is a supply contract with accessory installation, procured by open simplified procedure, non-divided in lots, with principal CPV 31527260-6 and accessory 45316100-6.

On subcontracting, both the tender platform and the INF-045-26 report state “no se permite la subcontratación”, so this is clear.

On guarantees, however, there is a dual regime: the project memory sets a 10-year guarantee for LED products/components, while the generic technical conditions refer to a 12-month guarantee period for the works in general; given the more specific and later justification in the project memory, the 10-year term should be understood as a special condition for the luminaires, coexisting with the standard 12-month work guarantee.

Similarly, the technical chapters refer to a formal reception act within one month of delivery or as defined in the administrative clauses, while the contracting report emphasizes that reception and payment are conditional on an OCA certifying achievement of required photometric levels; the latter is a specific condition that would prevail regarding the acceptance of the lighting system.

No explicit information is provided in the excerpt about question deadlines or mandatory site visits; the general safety documents contemplate coordination, signalling and meetings during execution but do not mention a pre-bid site visit requirement, so bidders would rely on the advertised terms in the formal announcement and platform rather than on any implicit obligation here.
