… contracting authority has HW resources (IP phones) and SW resources (licenses with support for HW resources) that are operated on Cisco Unified Communications Managers (see more detailed specifications of resources in Annex 1 to the draft contract), whereby SW resources are to cease to be valid in the future and without them HW resources cannot be used further and switching to other HW and SW resources would entail unreasonably high costs on the part of the contracting authority, the contracting authority considers that in this case it is justified by the actual subject of the public contract to refer to a specific product or SW resources - license / subscription and support of a specific manufacturer whose acquisition is the subject of this public contract. The contracting authority did not divide the public contract into lots, since the subject matter of the public contract forms a single functional unit and is awarded in a temporal context.
