What the buyer is looking for
The contracting authority does not allow the submission of partial tenders. The subject of the contract includes the execution, delivery and installation of elements of the arrangement of the permanent exhibition, which are an integral part of a single museum exhibition implemented on the basis of a uniform set design, architectural and substantive concept. The individual elements of the exhibition are in close functional, technical and aesthetic relationship, and their proper execution requires full compatibility of material, construction, multimedia and finishing solutions. Dividing the contract into lots would increase the risk of discrepancies in the quality of the workmanship, the technologies used, the colours, the finishing method and the integration of the individual elements of the exhibition, which could negatively affect the narrative and aesthetic coherence of the exhibition.…

… The lack of division of the contract is also justified by the need to ensure the timely implementation of the project. In the case of performance of the contract by several contractors, the risk of delays resulting from the need to agree on schedules, hand over works fronts and settle the issue of liability for possible incompatibilities or collisions between individual elements of the exposure would increase. In addition, the performance of the contract by a single contractor will allow for effective enforcement of warranty and guarantee liability for the entire arrangement, which is of particular importance in the case of a museum facility in which all elements of the exhibition function as a single integrated system. At the same time, the contracting authority considers that the lack of division of the contract into lots does not unreasonably restrict competition. There are specialized entities on the market with experience in comprehensive implementation of museum exhibitions and permanent exhibitions, including production, delivery and assembly of arrangement elements. The requirements to be met by economic operators will be defined in a way that is proportionate to the subject-matter of the contract and that preserves fair competition. In view of the above, the Contracting Authority considers that awarding a contract in a single procedure, without dividing it into lots, is the most rational solution from an organisational, technical, economic and qualitative point of view and will ensure that the intended exposure effect is achieved.
