Public tender: Supply of bread and cakes to Dom Pomocy Społecznej w Węgorzewie (2027)

The input text concerns a Polish public procurement procedure conducted under the Polish Public Procurement Law (Prawo zamówień publicznych – PZP) for the supply of bread and cakes to a social welfare home (Dom Pomocy Społecznej, DPS) in Węgorzewo for the year 2027.

The perspective is that of a Polish contracting authority applying Polish and EU‑related food safety and data‑protection rules.

The documents cited are the SWZ (Specification of Procurement Conditions) and its annexes, including the draft contract and statutory declarations required from bidders.

Such as in the description of the procedure, the SWZ explains that the tender is run in the “basic” procedure under art. 275(1) PZP, without negotiations, as a classic supplies contract below EU thresholds.

All interested economic operators may submit one electronic offer via the national Platforma e‑Zamówienia.

The documentation clarifies that the SWZ, together with annexes (Annex 1 – OPZ/formularz ofertowy, Annex 2 – exclusion statement under art. 125 PZP, Annex 3 – draft contract, Annex 4 – group‑of‑companies statement), forms the complete set of binding conditions, complemented by PZP, Civil Code and the special Polish act on counteracting support for aggression against Ukraine.

Regarding what the bidder must submit and minimum qualification requirements, such as in Rozdział II podrozdział 8 SWZ, the offer must include: the completed interactive Formularz ofertowy / OPZ (Annex 1) with unit net prices and VAT rates; an electronic Oświadczenie o niepodleganiu wykluczeniu (Annex 2) signed by qualified, trusted or personal e‑signature; and, where applicable, a power of attorney (for representatives or joint tenders), an indication of division of tasks among joint bidders, a list and justification of any “rozwiązania równoważne”, and any documents marked as trade secrets.

No experience references, turnover, insurance evidence or technical certificates are required as conditions of participation beyond legal capacity and absence of exclusion grounds.

On request after bid evaluation, the best‑ranked bidder must submit Annex 4 – the group‑of‑companies declaration under art. 108(1)(5) PZP.

The contracting authority does not require subject‑matter evidence (przedmiotowe środki dowodowe), does not impose employment‑under‑contract obligations, and does not require bid security (wadium) or performance security (zabezpieczenie należytego wykonania umowy).

On scope of the contract, such as in Annex 1 and the draft contract, the subject is cyclical delivery of bread and cakes of “Klasa I” quality, compliant with the Polish food safety act of 25 August 2006 and EU hygiene Regulation 852/2004, with products having at least half of their shelf‑life remaining at delivery, properly labelled with expiry dates and conforming to Polish Norms and GAP/GMP/GHP requirements.

Show all 29 statements

Quantities of individual assortment items are listed in the OPZ/formularz ofertowy but explicitly “nie są obligatoryjne” and may be increased or decreased depending on DPS needs; the contracting authority may reduce deliveries by up to 20% without compensation and shift quantities between items while staying within the maximum contract value.

Place of performance is DPS Węgorzewo (ul. 11 Listopada 12); deliveries are based on written orders (phone/fax/email/in person) to be fulfilled within 2 days, with possibilities to combine, advance or postpone deliveries in relation to weekends and public holidays, subject to prior agreement and written or documentary confirmation.

The overall performance period is from 01.01.2027 to 31.12.2027, and the final contract value equals actually delivered and accepted goods and may not exceed the amount set in §4(1) of the contract.

On award criteria and weighting, such as in Rozdział III pkt 4 SWZ, the only criterion is “Cena” (price) with a weight of 100 points.

The scoring formula is C = (CN / CR) × 100, where CN is the lowest gross price offered and CR is the gross price of the evaluated offer.

Only non‑rejected offers are evaluated, and the tender is awarded to the offer with the highest score.

In case of a tie, the tied bidders are asked to submit additional offers with new, not higher prices.

The contracting authority may seek clarifications on price and documents and must select the winning offer within the offer‑binding period (from 03.11.2026 to 02.12.2026, potentially extendable once by up to 30 days with the bidders’ written consent).

Concerning risks and special conditions, such as in §§5–8 of the draft contract, there are extensive contractual penalties and allocation of risks: delay in delivery per the agreed schedule triggers a penalty of 50 PLN per started hour (Mon–Sat 7:00–15:00), capped at 2,000 PLN per occurrence; failure to deliver ordered quantities incurs 100 PLN per undelivered assortment position; supplying non‑compliant or substandard goods triggers 100 PLN per case, and in case of contract termination due to the supplier’s fault, the customer may charge a penalty of 5% of the maximum gross contract value.

All penalties can be offset against the supplier’s invoices and may be cumulated up to 15% of the gross contract value; the customer may also claim additional damages on general civil‑law grounds and has the right to buy substitute bread from third parties at the supplier’s cost, including price differences.

The supplier must hold an up‑to‑date sanitary approval or registration decision for food establishments under the food safety act and bears all costs of any lab tests of disputed samples and of any poisoning incidents caused by poor‑quality goods (treatment, sanitary measures, compensation).

The customer may cancel the contract for 30 days after learning of major changes making performance contrary to public interest (e.g. closure of the DPS) and may reduce quantities without liability.

No mandatory site visit is required, no division into lots, no variant offers, no framework agreement or electronic auction are foreseen, and payments are made within 30 days of invoice receipt.

Questions on SWZ must be submitted via the platform; the customer answers at the latest two days before the offer deadline if the request arrives no later than four days before that deadline.

As to contradictions or corrections, such as differences in wording between OPZ and contract, the SWZ clearly states that all requirements in SWZ and annexes are minimum and mandatory and that failure to meet them leads to rejection under art. 226(1)(5) PZP.

The OPZ indicates quantities “may” change, while the draft contract concretises the mechanisms for reductions and shifts; these are consistent, as both confirm that listed quantities are estimative and adjustable within the maximum contract value and permitted percentage limits.

Similarly, the SWZ states that no subject‑matter evidence or economic/technical qualification documents are required, and this is mirrored by the absence of turnover, insurance or experience clauses in the contract.
