Tender for successive supply of lubricants for ESMASA’s vehicle fleet (Expediente L34-26)
The input text concerns a public procurement procedure in Spain, specifically a supply contract tender published on the Plataforma de Contratación del Sector Público by the Empresa de Servicios Municipales de Alcorcón, S.A.U. (ESMASA).
It regulates the successive, unit-price supply of lubricants, greases, oils and additives needed for the municipal company’s fleet maintenance.
The point of view is that of a Spanish contracting authority, applying Spanish public procurement law (LCSP) and EU Directive 2014/24/EU, but the contract is not subject to harmonized regulation.
Such as regards what bidders must submit and minimum qualification, the tender is structured in two electronic envelopes through PLACSP: Sobre 1 (administrative documentation) and Sobre 2 (offer evaluated by formulas).
Solvency económica y financiera requires a volume of annual business, in the best of the last three financial years, at least equal to 100% of the estimated contract value (79,861.71 EUR), evidenced by: for individuals, a responsible declaration (Annex I); for companies, approved annual accounts; and for newly created companies, a civil liability insurance covering contractual non-compliance for that solvency amount.
Solvencia técnica or professional requires, such as, a list of similar contracts over the last three years amounting to 100% of the estimated value, supported by invoices, contracts or certificates of good execution; for new companies, a description and supporting documentation of logistics facilities, transport and storage means, quality control measures and supply capacity, with no prior experience required.
Additionally, bidders must commit via Annex VII to the permanent assignment of sufficient transport and storage means, and designate a single contact person with email and telephone for orders and contract follow‑up.
As for the scope of the contract (what, how much, where, when), the contract object is the supply of lubricants, greases, oils and additives for the maintenance of ESMASA’s heterogeneous fleet (such as refuse trucks, sweepers, vans, cars and machinery), by tracto sucesivo and prices unitarios under article 16 LCSP.
The estimated value and base budget are 79,861.71 EUR (without VAT) and 96,632.67 EUR (with VAT), with components coinciding with the PBL.
Duration is up to 18 months from the day after formalization or until the budget is exhausted, whichever comes first, with no prórrogas.
Place of performance is primarily ESMASA’s facilities at C/ Químicas 26/30, 28923 Alcorcón (Madrid), with the possibility of punctual changes of delivery address within the municipality upon prior notice.

The ordinary maximum delivery time is 4 calendar days from receipt of firm order by email, though bidders can offer shorter times for scoring.
Technical specifications and item quantities are detailed in the PPT and in Annex III (price table) L34‑26.xlsx, including, for example, certain brand- or reference-specific lubricants justified by vehicle manufacturers’ warranty requirements.
Regarding award criteria and weighting, the procedure is open, with no electronic auction, and only objective, formula-based criteria.
The offer económica carries up to 90 points, calculated by multiplying unit prices offered by estimated consumption and then using a proportional formula (Povᵢ = Pc × (Omb / Ovi)) to rank offers against the minimum-priced admissible offer.
The second criterion is plazo de entrega, worth up to 10 points, such as: delivery within <24 hours (10 points); <48 hours (7.5 points); <72 hours (5 points); and ≤96 hours (0 points) from the firm email order to receipt at ESMASA.
The tender also defines how “ofertas anormales o desproporcionadas” are detected, based on percentage deviations from the PBL or media de ofertas, depending on the number of bidders, plus the requirement that the bidder’s score in non-price objective criteria exceeds 85% of the maximum.
The offer’s validity period is 18 months.
On risks and special conditions, the bidder faces a definitive economic guarantee of 5% of the “presupuesto máximo” (effectively the base budget), to be constituted before award, and maintainable throughout contract execution and any hypothetical extensions.
It may be provided, such as, by bank guarantee (Annex IV), surety insurance (Annex V) with payment on first demand and no suspension for unpaid premiums, or retention in the first invoices (Annex VII, to be requested before award and shown in the first invoice).
A technical guarantee applies to each product supplied, including packaging, contents and carriage, for 12 months from receipt.
There are specific penalties: for delay, 1% of the price of the delayed order per working day plus 50 EUR per day beyond the offered delivery time; for defective execution, replacement of defective product plus 50 EUR per working day of delay due to replacement.
Environmental conditions are a contractual essential condition under article 202 LCSP: the contractor must prioritize fully electronic management of communications, reports, invoices and documentation, minimizing paper; non-compliance can lead either to contract resolution or penalties up to 10% of the contract price (excluding VAT).
Furthermore, there is an essential obligation to comply with EU and Spanish data protection law (art. 211.1.f LCSP), even though the contract does not require personal data processing on behalf of the controller.
Subcontracting is not specifically regulated in the excerpt, so the general LCSP regime applies.
Invoicing must be monthly, in PDF sent to [email protected], within four days of issuance, with detailed breakdown per order and delivery note; payment is by bank transfer only, within 30 days of invoice approval.
Foreign bidders with fiscal domicile outside Spain must provide a tax residence certificate for double taxation treaties.
The deadline for offer submission is 11/11/2026 at 23:59 via PLACSP; any queries must logically be addressed to the contracting authority (contact: [email protected], phone 697 444 274), although a specific question deadline and site visit are not mentioned in the provided text.
As for contradictions or corrections among documents, the texts are largely consistent: they all state the same contract value, duration (“18 meses o hasta que se agote el presupuesto básico de licitación, lo que primero ocurra, sin posibilidad de prórroga”), location (Alcorcón, C/ Químicas 26/30), and criteria (90 points price, 10 points delivery time).
A minor apparent discrepancy is that some generic platform fields say “No se aceptará factura electrónica” or “No se utilizará el pago electrónico”, while the CCP explicitly allows ESMASA to require factura electrónica later with one month’s notice and specifies that invoices be sent in PDF by email and paid by bank transfer.
In practice, the CCP/PCAP and PPT—being the specific pliegos—prevail over generic platform descriptors, so the detailed clauses on invoicing and the possible future obligation of electronic invoices are the binding reference.
Similarly, any generic mention that orders, electronic invoices or electronic payment “No” will be used is overridden by the more specific clause that orders will be placed by email, invoices will be emailed as PDFs and payments made by transfer.
Overall, when in doubt, the Cuadro de Características Particulares and CCP/TCP text take precedence over high-level platform metadata.
Only the contracting authority's tender documents are binding. As of: 29/10/2026
