Public procurement for water analysis services at Cantabrian landfills
The input text concerns a Spanish public procurement procedure launched by the regional public company Medio Ambiente, Agua, Residuos y Energía de Cantabria, S.A.
(MARE), relating to “Servicios de analíticas de aguas de vertederos” (water analysis services for landfills) in Cantabria, Spain.
It is clearly written from the perspective of Spanish public contracting law (Ley 9/2017 de Contratos del Sector Público) and refers to national bodies such as ENAC and the Confederación Hidrográfica del Cantábrico, so the country point of view is Spain.
The documentation includes the justification report, price-setting criteria, contract term, and award criteria as published in the Spanish national procurement platform (PLACSP).
The input text provides background on the contract by explaining that MARE needs specialized external services to perform water analyses at two landfills (Meruelo and El Mazo) because its previous provider (CIMA, a public environmental research center) lacks certain required accreditations.
As such, the contract is for laboratory and sampling services related to lixiviates, groundwater, surface waters and runoff in and around the landfills.
The documents, such as the “Memoria justificativa” and “Criterio utilizado para la fijación del importe de licitación”, describe how regulatory obligations (Autorización Ambiental Integrada, requirements from the Confederación Hidrográfica del Cantábrico) drive the need for periodic analyses and justify the estimated quantities and budget.
Regarding what bidders must submit and minimum qualification requirements, the text indicates that the offer is presented electronically via PLACSP in two envelopes: a “Sobre Declaración Responsable” containing an administrative responsible statement as per clause 2.1.2 of the administrative clauses, and a “Sobre Oferta económico-objetiva” with the economic offer, as per clause 2.1.3.
As such, detailed solvency documents (turnover figures, references) are initially marked “no aplica”: they are not submitted with the offer but will be requested from the bidder ranked first before award, according to articles 140 and 150.2 LCSP.
Minimum economic and technical solvency are, however, defined in the justification report: for example, the annual business volume in the best of the last three years must be at least 100% of the annualized value maximum of the contract, and similarly the annual volume of similar services executed must reach 100% of the contract’s annualized maximum value.
In addition, new companies (under five years) can accredit economic solvency via professional liability insurance equal or greater than 100% of the contract’s annualized maximum; their technical solvency is accredited by listing staff and services performed meeting the same 100% threshold.
Specific professional certificates are also required: sampling entities must be ENAC-accredited under UNE-EN ISO/IEC 17020, laboratories must be ENAC-accredited under UNE-EN ISO/IEC 17025 for relevant parameters, and entities performing runoff and continental water sampling must be recognized as ECAH (Entidad Colaboradora de la Administración Hidráulica).

As to scope—what, how much, where and when—the text specifies that the contract covers water analyses at two sites: the non-hazardous waste landfill of Meruelo and the El Mazo treatment center and landfill, both in Cantabria (Spain).
The scope includes, such as, analytical control of lixiviates (before and after pre-treatment), waters of escorrentía (runoff), continental surface waters and groundwater.
Quantities are detailed in the cost calculation tables: for Meruelo, for instance, 4 analyses of lixiviates before pre-treatment, 4 after pre-treatment, 18 analyses of runoff water, 28 analyses of continental waters, 10 analyses of groundwater, and 4 sampling campaigns (each including sampling and related work) per year, generating annual costs of 22,928.80 € for that installation; El Mazo adds 4 lixiviate analyses, 12 continental water analyses, 10 groundwater analyses, and 2 sampling campaigns per year, totalling 12,226 € annually, which together form the estimated annual maximum of 35,154.80 € (excluding VAT).
The contract is a service contract “en función de las necesidades” with an initial duration of 1 year and the possibility of one annual extension, so the total term cannot exceed 2 years.
It will start after the current contract ends (after 17 January 2027) and the acta de inicio must be signed within 15 days after formalization; the contract finishes either at term or if the authorized maximum economic amount is exhausted.
Award criteria and weighting are described as purely economic: the procedure is open, ordinary, non-harmonized, with a single criterion of evaluation—price—weighted at 100%.
As such, the most economically advantageous offer is defined as the one with the highest price reduction (%Boi) over the Presupuesto Base de Licitación (PBL) of 35,154.80 € (excluding VAT), which corresponds to 42,537.31 € with VAT.
The evaluation formula is explicitly given: %Boi = 1 – (Oi / PBL), where Oi is the bidder’s offered total price.
All offers are ranked in decreasing order of %Boi, with no qualitative technical scoring or social criteria besides the mandatory solvency and execution conditions.
The contract value framework is also set: the Presupuesto Máximo de Ejecución (PME) including a possible one-year extension equals 70,309.60 €, and further potential modifications add 20% (7,030.96 €) plus a 10% measurement excess (3,515.48 €), leading to a Valor Máximo del Contrato (VMC) of 80,856.04 € excluding VAT.
On risks and special conditions, the input text mentions, such as, a definitive performance guarantee of 5% of the contract amount, the allowance of subcontracting under strict conditions, and the possibility of contract assignment (cession) subject to MARE’s authorization and the assignee meeting all solvency and technical requirements.
Subcontractors must hold the same professional accreditations (UNE-EN ISO/IEC 17020/17025, ECAH where applicable), and the bidder must indicate in its offer any part of the contract intended to be subcontracted, in line with Decreto 75/2019 on social clauses in Cantabria’s public procurement.
The justification report also sets environmental special conditions of execution under article 202 LCSP, such as optimization of travel for sampling campaigns (grouping sampling tasks to minimize unnecessary trips) and prioritization of electronic documentation to reduce printing; these are not classified as essential obligations.
The validity period of the offer is two months.
The procedural information includes submission deadlines (offers until 11/11/2026 at 12:00, retrieval of tender documents until 11/11/2026 at 11:59), the absence of electronic auction, and general recourse information (appeals to the Consejería de Fomento, Vivienda, Ordenación del Territorio y Medio Ambiente).
The text does not mention penalties or a mandatory site visit explicitly, but given Spanish practice, such conditions, if any, would be in the full Pliego de cláusulas administrativas and Pliego de prescripciones técnicas referenced but not fully reproduced here.
Regarding contradictions or corrections within the documents, there is an apparent inconsistency in the “Opciones y prórrogas” field of the procurement notice (which states “Número máximo de prórrogas: 0”) versus the separate “Plazo” document and the “Acuerdo de Inicio de Expediente” and “Memoria justificativa”, which repeatedly state a duration of one (1) year with the possibility of one (1) annual extension, and a maximum total duration of two (2) years.
Given the detailed internal documents and the breakdown of PME (which explicitly includes a one-year prórroga), the statement that clearly applies and should govern is the more specific and reasoned internal determination: 1 initial year plus 1 possible extension, total 2 years.
Similarly, while the platform’s summary fields for solvency say “indicar ‘no aplica’” at the submission stage, the binding requirements are those set in the Memoria justificativa (100% annualized contract value thresholds, insurance alternative for new companies, and detailed technical references), which will be enforceable when MARE requests documentation from the first-ranked bidder before award.
Only the contracting authority's tender documents are binding. As of: 28/10/2026
