Contract for updating and revising the urbanization project of Sector 6 Binibeca Nou – S’Atalaia (Sant Lluís, Menorca)

The input text concerns a public service contract procedure launched by the Ayuntamiento de Sant Lluís (Municipality of Sant Lluís) in Menorca, Spain.

It is a Spanish local-government procurement under the Spanish Public Sector Contracts Law (Ley 9/2017, LCSP) for intellectual services in architecture and engineering.

The perspective is that of a Spanish contracting authority, with references to Spanish and EU legal frameworks, and the contract is advertised on Spain’s Plataforma de Contratación del Sector Público.

As background, the documents explain that the municipality lacks sufficient internal technical resources (only one architect, one technical architect, one engineer and one draughtsman) and therefore must externally contract the “Servicio de actualización y revisión del proyecto de urbanización del Sector 6: Binibèquer Nou – S’Atalaia”.

The original urbanization project dates from 2004 and must be updated to current planning rules (NN.SS., PTI), technical standards, phasing and environmental requirements.

The contracting procedure is an abierto simplificado (simplified open procedure) with multiple award criteria, ordinary processing, and the Junta de Gobierno Local acting as contracting authority.

Regarding what the bidder must submit and minimum qualification requirements, the text specifies that offers are presented electronically via the state platform (PLACSP), in Catalan or Spanish, in two envelopes: Sobre A for documentation administrativa y criterios sometidos a juicio de valor, and Sobre B for the oferta económica y evaluable mediante fórmulas.

Such as described in the platform notice, Sobre A contains administrative eligibility documents (capacity to contract, no prohibitions, tax and social security compliance) and the technical proposal (memòria tècnica) used for judgment-of-value criteria, while Sobre B contains the price and other automatically-scored elements (BIM, time reduction).

For solvency, bidders must prove: (a) economic/financial solvency via professional liability insurance of at least 120,000 € with a commitment to maintain coverage throughout the contract; and (b) technical/professional solvency via references for similar urbanization/re-urbanization project design services executed in the last three years, with an annual amount in the best year of at least 49,000 € (excluding VAT), certified by public or private clients, or by employer declaration with supporting documents.

Additionally, the selected bidder must submit a signed declaration committing to allocate minimum personal resources: one lead technical director (civil engineer, “ingeniero de caminos”, architect or equivalent) with at least 5 years’ experience in urbanization project design; one technician competent in urban service networks; and one technician competent in topography.

Such as detailed in the solvency section, bidders must attach nominal list of team members, copies of diplomas and certificates (including homologation where degrees are foreign), and signed CVs; external collaborators must sign responsible declarations committing to work for the firm if awarded.

On the scope of the contract (what, how much, where, when), the documents state that the object is the redaction of the update and review of the urbanization project for Sector 6 Binibeca Nou – S’Atalaia, initially authored by ECCP Joan Moll Serra in 2004.

Such as spelled out in the need report, tasks include: adapting alignments, green areas and public facilities to current NN.SS.; updating technical regulations (especially installations); revising materials and finishes for sidewalks and roadways, and lighting design and efficiency; structuring execution in phases according to the polygonal subdivision; revising and adapting the project’s report, specifications, safety and health study, quantity take-offs and budget; and drafting the documentation for a simplified environmental impact assessment under Balearic Law 12/2016.

The estimated contract value is 70,000 € (excluding VAT); the budget base de licitación is 70,000 € + VAT = 84,700 €.

The contract is classified under CPV 71240000 (architecture, engineering and planning services) and CPA 71.12.12.

The place of performance is Menorca (ES533), Spain.

The municipality will provide the awarded contractor with the existing project (plans, report, quantities and budget), topographical survey in CAD, and GIS/CAD planning modification plans.

Deliverables must be provided in non-editable signed digital formats (PDF) and also in editable forms (CAD for plans, word-compatible for text, BC3 for budget), and must include all standard components of an urbanization project: descriptive memorandum, situation/information plans, project and detail plans, technical and economic-administrative specifications, quantity take-offs, price breakdowns, budget, safety and health study, and waste management documentation.

Award criteria and weighting are clearly detailed and later corrected.

The contract uses multiple criteria with at least 51% of the score linked to quality, and judgment-of-value criteria capped at 45% of total, in line with LCSP arts. 145.4 and 159.1.b.

However, a complementary report dated 19/10/2026 corrects this and states that automatically quantifiable criteria sum to 75 points (still price 49, time reduction 10, BIM 16) and judgment-of-value criteria remain 25 points for the memòria tècnica.

Such as indicated in the complementary report, this corrected 75+25 scheme is the one that applies.

As to risks and special conditions (penalties, guarantees, subcontracting, validity period, question deadline, site visit), the texts provided focus mainly on solvency, format and subcontracting but still mention some risk-related aspects.

A definitive performance guarantee of 5% of the contract amount is required, as stated in the platform listing (“Garantía Requerida Definitiva Porcentaje 5 %”).

Subcontracting is explicitly not permitted: the platform notice says “Subcontratación permitida: No se permite la subcontratación,” and the need report explains that project drafting is considered a critical task under LCSP art. 215.2.e and therefore must be executed directly by the contractor without subcontracting.

The texts do not explicitly state the validity period of offers, question deadlines or any mandatory site visit; instead they mention a general 15-calendar-day period from publication for submitting tenders, electronic submission only, and that all further procedural characteristics, including any Q&A, are governed by the pliegos.

Such as highlighted in the governance documents, the Mayor’s resolution and the Junta de Gobierno’s agreement authorise the expenditure (84,700 €), approve the pliegos (administrative and technical), and order the publication of the tender notice on the contracting profile and public procurement platform.

Finally, regarding contradictions or corrections, the only explicit correction concerns the award criteria scoring.

The initial “Informe raonat de la necessitat” wrongly stated that automatically quantifiable criteria could reach 80 points and gave BIM only 10 points for full BIM plus digital twin.

The “Informe complementari” issued by the municipal architect on 19/10/2026 notes this error and modifies section 6 so that automatically quantifiable criteria total 75 points, with BIM worth 16 points for the same deliverable.

The Plataforma de Contratación notice is consistent with this corrected scheme.

Therefore, where there is a discrepancy between 80 and 75 points for automatic criteria and between 10 and 16 points for BIM, the corrected complementary report and the platform notice prevail and are the applicable interpretation for bidders.
