Contract for conditioning works at Ludoteca Hércules in Melilla

The input text concerns a public works contract issued by the Ciudad Autónoma de Melilla (Spain) for the “Obras de acondicionamiento de la Ludoteca Hércules” in the Cañada de Hidúm neighbourhood.

The point of view is clearly Spanish public procurement law (LCSP, REGA, etc.), with no other countries mentioned except in the abstract legal references to EU/EEE operators.

As background, the documentation includes: the announcement of the tender on the Plataforma de Contratación del Sector Público, the “Memoria justificativa”, and the resolution approving the procurement dossier, together with references to the PCAP and PPT (administrative and technical specifications).

It describes a third tendering process for the same works, framed under Spanish Law 9/2017 on public sector contracts and related regulations (LCSP, LOE, CTE, DMSyS, etc.).

The contract type is “Obras” and the procedure is “abierto simplificado” with ordinary processing and no EU-harmonised regulation applying.

Regarding what bidders must submit and the minimum qualification requirements, the text states that during the tender phase only “Anexo III” and registration in ROLECE are required in Sobre 1 (documentation administrativa y criterios sometidos a juicios de valor).

Full capacity and solvency must nevertheless be held at the end of the offer period as set out in point 13 of Annex I to the PCAP, but their detailed content is in that PCAP (not reproduced here).

The solvency and aptitude regime is referenced to “Cláusula 2 (Condiciones de aptitud)” and “Cláusula 12 del Anexo I”, and for EU/EEE non‑Spanish firms to arts. 88 and 89 LCSP.

A specific classification is required: contractor classification in Group C, Subgroup 4, Category 1 for works, which the documents cite as the way to accredit economic/financial and technical solvency, even though the legal threshold (500,000 €) is mentioned only as a general rule.

No explicit details on turnover, insurance, or technical references appear in the extracted text: they are stated only generically as “one or several of the means” in arts. 88 and 89 LCSP, “a elección del órgano de contratación”, as defined in the PCAP.

On the scope of the contract, the documents define the object as conditioning works to remedy construction and installation deficiencies and enable the Ludoteca Hércules for socio‑educational and community uses.

The place of performance is Melilla, at calle Hércules s/n, barrio Cañada de Hidúm (Subentidad Nacional ES640).

Show all 30 statements

The estimated value is 105,670.16 € (IPSI excluded), and the “Presupuesto base de licitación” including IPSI is 116,237.17 €.

The execution period is six (6) months.

The contract is not divided into lots; there is an explicit justification under art. 99.3 LCSP that the technical nature and need for coordination of the works make lot division technically unsuitable.

The offer submission period is 35 days as per art. 156 LCSP, and the announcement fixes the deadline on 24/11/2026 at 15:00, with a further provision that, for technical reasons of the platform, bids may be submitted until 15:00 on the next business day.

On award criteria and weighting, the contract uses a “mejor relación calidad‑precio” formula with multiple criteria, as required by arts. 145.1, 145.5 and 145.6 LCSP.

Specifically, as stated, the evaluated criteria are: (i) price offer (economic criterion) weighted at 75 points, and (ii) a qualitative “Memoria” evaluated by judgement of value weighted at 25 points.

The overall score is defined by the formula: Puntuación del licitador = (25/100 × JdV) + (75/100 × EmF, where JdV are criteria under judgement of value and EmF those evaluable by formula.

The price cannot be the only decisive factor and the qualitative memory is designed to capture aspects that affect proper execution and quality of the works.

In terms of risks and special conditions, the documents specify a definitive guarantee of 5% of the contract price and an additional complementary guarantee of 5%.

Subcontracting is allowed (“Subcontratación permitida”) with reference to more detailed conditions in point 17 of Annex I of the PCAP.

The validity of offers is two (2) months.

The contract is not subject to regulation harmonised at EU level and is not co‑financed by EU funds (no FSE/FEDER/PRTR).

Electronic auction is explicitly excluded (“no se adjudicará mediante subasta electrónica”), electronic ordering and payment are not used, but electronic invoicing is accepted.

Penalties for delay or other breaches, insurance obligations, and detailed health and safety or waste management obligations are only mentioned by reference to the applicable regulations (CTE, DMSyS, RD 105/2008) and PCAP/PPT; their concrete amounts or mechanisms are not visible in the extracted text.

Question deadlines and site visits are not described: the only temporal reference is to the general submission period and the extended final minute support of the platform’s technical assistance.

As for contradictions or corrections within the documents, the contract is sometimes described as “obra de reforma” (per art. 232 LCSP) and elsewhere as “obra de conservación y mantenimiento” (art. 232.1), while the CPV is given both as “45453100 - Trabajos de reacondicionamiento” and “45453100-8 Trabajos de reforma”.

Another apparent tension lies in the solvency justification: the text cites art. 77.1.a) LCSP, which makes classification mandatory for works above 500,000 €, yet the contract value is far lower (105,670.16 €).

No direct contradictions are seen regarding amounts, deadlines, or guarantees: the repeated figures (value, budget, execution period, guarantee percentages, offer validity, award weightings, submission deadline) are consistent across the various snippets, so the applicable statements are those summarised above and detailed in the PCAP and PPT.

Tactics

When this buyer has awarded in this sector, there was usually a single bid in the end. A solid bid has a real chance here. (Based on 6 completed awards — not a statement about this procedure.)

This procedure allows 39 days between publication and deadline — typical in this country is 27 (median of 7,300 procedures). Much more generous than usual — time for a thorough bid rather than a quick one.

Foreign bidders

In Spain · Construction work, 90 contracts went to foreign companies over the last 3 years (of 100,713 recorded awards) — mostly from Portugal, Italy, France.

Measured from linked award data; foreign winners bidding through a local subsidiary count as domestic — the true share is higher.
