Dynamic Purchasing System for Spare Parts for Depuration Gearboxes (EMAYA – Exp. 002484/2026)

The scope of the contract is the supply of spare parts for gearbox types used in depuration equipment, structured into four internal categories: Reductores BONFIGLIORI 1 (37,200 EUR), Reductores ROSSI (24,200 EUR), Reductores PUJOL MUNTALÀ (9,000 EUR) and Reductores ST GROUP (9,000 EUR).

Award criteria and weighting operate differently at admission stage and at based-contract stage.

In case of a tie between offers, such as explained, preference goes first to companies with a validated equality plan or equivalent equality certification, then to those with higher percentages (and numbers of permanent) disabled employees, and if still tied, a draw is conducted.

Such as defined in the special execution conditions (art. 202 LCSP), all documentation and communications during contract execution must be in digital format (searchable PDF) wherever possible; if physical paper must be used by the contractor, it must be 100% recycled or FSC-like certified.
There is no general price revision, and no definitive guarantee is required for admission to the SDA, although EMAYA reserves the right under art. 107.5 LCSP to request a guarantee for high-value based contracts, to be provided in cash, bank guarantee, or surety insurance as per art. 108 LCSP.
A mandatory civil liability insurance with minimum cover of 300,000 EUR per claim and year is required, covering third-party material and personal damage and consequential loss.
Subcontracting is allowed in general and governed by art. 215.2.b LCSP and the PCAP, with no task classed as “critical” and non-subcontractable.
The validity period of offers for the SDA is six months (as indicated in the generic contract notice data), and the period for submission of proposals is 30 calendar days from the day after publication in the contracting profile, until 23:59, automatically extended to the next working day if deadline falls on Saturday or public holiday.
Offers must be submitted electronically via EMAYA’s procurement portal, within defined file-size limits (8 MB per file if signed electronically, 30 MB otherwise, total envelope max. 100 MB), and in case of technical failure not attributable to the bidder, a special electronic fingerprint procedure via email to [email protected] is described.

On payment conditions, EMAYA reserves 30 days to inspect and accept supplies; invoices are paid within 30 days of approval, must be electronic and sent to [email protected], and interests on arrears accrue only after these periods; any refunds to EMAYA require separate corrective invoices.
Special penalties include: for defective or low-quality supplies, a penalty equal to 200% of the value of the supply; and for delay, 15% of the product value per day of delay up to a maximum of 200% of its value.
Breach of environmental execution conditions carries an additional specific penalty of 1% of the contract award price.
Such as seen, one apparent tension is that Section III on criteria for SDA establishment states that “no criteria of valuation” apply to the admission procedure (admission purely by solvency), while elsewhere there is an “Acta de valoración” using formulas for economic offer and delivery time; however, that acta relates to evaluation of technical/economic aspects and proposal of adhesion to the SDA once solvency is checked, and for future based contracts, not to competitive scoring among candidates at initial admission.
Another subtle point is that the generic Plataforma notice mentions a “cantidad mínima 99”, which does not reappear or is explained in the pliegos, so in case of doubt the detailed pliegos (PCAP and PPT) prevail over the generic platform metadata.
Similarly, while equality and disability criteria are mentioned under “condiciones determinantes de adjudicación en caso de empates”, they are explicitly limited to tie-breaking situations and do not constitute regular award criteria.
Where differences exist between general notice text (“según lo determinado en los pliegos”) and specific parameters in the pliegos (e.g., solvency percentages, category amounts), the specific pliego provisions (economic solvency 100% of 39,700 EUR; technical solvency 70% of 39,700 EUR; four categories and their values; no prórrogas) are clearly intended to apply.
