Procurement of waste bins for Fedasil Zoutleeuw (FED 2026 1450)
The input text concerns a Belgian public procurement procedure launched by Fedasil (Federal Agency for the Reception of Asylum Seekers) for the purchase of waste bins for the Fedasil reception centre in Zoutleeuw.
It is an “overheidsopdracht van beperkte waarde” under Belgian law (wet van 17 juni 2016, KB’s of 2013, 2017, 2024), so the country point of view is Belgium and the rules, thresholds and references are all based on Belgian public procurement legislation.
The documents describe a one‑shot supply contract for waste bins.
The scope is set out in Bijlage C (technical specifications) and Bijlage B (inventory/price form).
Bijlage B indicates the quantities for the whole duration of the contract: 9 units of “Afvalbak (zie bijlage C)”, 1 unit of “Transport”, and 1 unit of “Andere kosten”.
The place of performance is clearly specified as Zoutleeuwse Steenweg 11, 3440 Zoutleeuw, Belgium.
The duration is defined as a single delivery (“one shot opdracht”) within a maximum of 15 calendar days from sending the purchase order (bestelbon).
As to what must be submitted and minimum requirements, the bidder must at least submit a signed offer including all requested information and a completed Bijlage B (the green cells: unit prices, totals, VAT, plus name, date, signature).
There is no mention of references, minimum turnover or specific insurance requirements beyond normal legal obligations.
However, because the contract concerns machines/equipment, Bijlage C imposes mandatory technical conditions: compliance with laws and regulations on safety and health, provision of user manuals in the language of the user (and NL/FR in Brussels, though the performance place is Zoutleeuw in Flanders), CE marking for all products and CE conformity certificates where needed.
The offered products must match the detailed technical description (e.g. waste bin ~45L, pedal, soft‑close lid, food‑waste suitable, steel, fire‑resistant, robust, specified dimensions), or be “merkgelijkwaardig” as allowed by the “of gelijkwaardig” clause.

Offers must be signed by a person authorised to economically bind the company.
General terms may be added only insofar as they supplement, not contradict, Fedasil’s conditions; any conflicting clause will be null.
Regarding award criteria and weighting, the procedure is explicitly described as an assignment of limited value (< 30,000 EUR excl.
VAT) where only one award criterion applies: price.
The award criterion is “alleen de prijs (de laagste prijs), bepaald op basis van het totaal bedrag van de inventaris / de offerte”.
There are no qualitative criteria, no weighting matrix; the contract is simply awarded to the compliant tender with the lowest total price as per Bijlage B. Fedasil reserves the right to negotiate (including regularisation of missing documents or clarification, or improvement of price and other conditions) and to invite submission of a “BAFO – best and final offer”.
In such a negotiation scenario, the commitment period of all offers is automatically extended as described.
Concerning risks and special conditions, several elements are described.
Such as: prices are global and fixed (forfaitaire hoeveelheden; no price revision allowed), so bidders bear the risk of cost changes over the contract period.
Payment terms follow the Belgian KBU: invoicing only after complete performance, via the Mercurius/PEPPOL e‑invoicing platform, and payment within 30 calendar days from acceptance of delivery, provided a properly issued invoice and required supporting documents are available.
The order is formalised by a purchase order (bestelbon) sent by Fedasil, possibly preceded by an informative email.
Execution rules of KB 14/01/2013 apply, including delay penalties, detection of execution errors and “ambtshalve maatregelen”; however, the formalism is simplified (PV of putting in default and unilateral measures can be sent by email instead of registered mail).
There is no mention of performance guarantees, bank guarantees, or specific limitations on subcontracting.
There is a confidentiality clause regarding personal data (GDPR compliance) and a requirement to consider the gender dimension under Belgian “gender mainstreaming” law.
The validity period of offers is 30 calendar days from the submission deadline, and is extended in case of negotiations to 30 days from the BAFO receipt deadline.
Site visit and information session are explicitly “zonder voorwerp”: no site visit or information meeting is foreseen.
A deadline for questions is not explicitly mentioned in the excerpts, but offers must be received before the final date/time indicated in the original request.
Finally, on contradictions or corrections, the text is largely consistent.
The tender is repeatedly characterised as an “overheidsopdracht van beperkte waarde” with an estimated value below 30,000 EUR excl.
VAT, governed by specific parts of the wet van 17 juni 2016 and related KB’s; there is also the explicit statement that there is no obligation to award or conclude the contract (art. 85 of the law).
Where the documents might seem redundant (e.g. repeated statements about CE marking, price being global and forfaitary, no price revision), they are confirmations rather than contradictions.
If a bidder’s general terms conflict with Fedasil’s conditions, the documents clearly state that Fedasil’s administrative and technical conditions prevail and any conflicting clause from the bidder is null.
Similarly, if there were any doubt between a brand name and equivalence, the statement “elke merk en/of representatie (foto, ...) moet worden geïnterpreteerd als ‘of gelijkwaardig’” means that equivalence is allowed provided the technical requirements in Bijlage C are met.
