Regarding scope of the contract (what, how much, where, when), the texts explain that the subject is the purchase and delivery of new specialist devices for university workrooms for users with special needs, split into three lots: Part 1 various equipment (including e.g. monitors, wired mice, etc.), Part 2 an A3 flatbed/book scanner, and Part 3 LED magnifying lamps. For each item, detailed minimum technical parameters and accessibility features are set, along with broad “klauzula równoważności” allowing equivalent solutions not worse than the specified standards. Quantities include, such as, three mice, one scanner, two LED lamps, and additional ICT equipment as defined in Annex 1. Place of performance is the Uniwersyteckie Centrum Wsparcia Osób z Niepełnosprawnościami, ul. Śląska 11A, Kielce; delivery includes transport, unloading, bringing into indicated rooms, configuration, testing, user instruction and handover. The execution period is up to 4 weeks from contract signature, within working days 8:00–15:00, with the exact delivery date agreed with the contracting authority; performance is deemed completed on signing the acceptance protocol.

Award criteria and weighting are defined simply: the most advantageous offer is selected based on (a) price – 80% weight; points = (lowest gross price / evaluated gross price) × 100 × 0.8; and (b) length of warranty and statutory warranty (rękojmia) – 20% weight, with 24 months as a mandatory minimum (0 points), 36 months (10 points) or 48 months (20 points). The price must be a gross PLN amount including all costs (equipment, delivery, installation, training, etc.) and using a 23% VAT rate for calculation on the offer date. The authority signals it will seek permission to apply a 0% VAT rate for eligible computer equipment; if such permission is granted, the contractor must correct the VAT invoice to remove the tax amount.

On risks and special conditions, the draft contract and SWZ impose, such as, extensive guarantee and defect‑liability obligations (minimum 24 months, with free removal of defects or replacement; obligation to start repairs within 48 hours of written notice and complete within 14 days or 7 days if work is impossible). The contractor must replace defective items within 7 days, provide temporary replacement components where removal would disable equipment, and bear transport costs for repairs. Contractual penalties include 0.5% of gross contract value per day of delay in execution and 0.5% per day of delay in removing defects (each capped at 10%), and 10% of gross value for contract termination due to contractor fault; symmetric penalties apply to the contracting authority’s delay in acceptance or termination due to its fault. Total penalties are capped at 20% of gross value, but additional damages may be claimed. There is no bid bond (wadium) and no performance security required. Special ICT/cyber‑security clauses forbid products/services/processes designated as high‑risk under the Polish cyber‑security act; violation triggers a 20%‑of‑contract‑value penalty and can justify termination. The offer validity period is 30 days after the submission deadline (until 8 December 2026), with a possible one‑time extension by up to 30 days. Questions and all communication must go through the e‑Zamówienia platform; the documents also describe appeal and complaint procedures to the National Appeal Chamber and the public procurement court. No site visit is prescribed, and no framework agreement or reserved contracts are foreseen.

Regarding contradictions or corrections within the documents, the texts largely align: the SWZ and OPZ both set a minimum 24‑month warranty and allow longer periods to be scored; the contract general clause sets the warranty period by blank to be filled in, consistent with the offer (and thus with the SWZ scoring table). Both SWZ and OPZ define equivalence similarly and place the burden of proof on the contractor. There is some generic boilerplate (for example, about levels of capacity for construction works) that does not apply to this supply contract but does not create a direct conflict. Where differences could theoretically arise (such as specific technical parameters, guarantee length, or ICT restrictions), the SWZ and its annexes (Opis przedmiotu zamówienia, Formularz asortymentowo‑cenowy, Projekt umowy) are declared integral, and the contract explicitly refers back to the SWZ and the contractor’s offer; therefore, in case of divergence, the binding interpretation is the one in the SWZ/OPZ as incorporated into the signed contract.
