Transport et acquisition de polystyrène expansé (EPS)

✓Bidders must also submit a completed Uniform Europees Aanbestedingsdocument (UEA) in XML and PDF, and later provide supporting documents including recent attestations for fiscal and social obligations and uittreksels uit het strafregister for the legal entity and all board/management/control members.

✓Milieubescherming (EPS-deeltjesbeheersing) counts for 6 points, evaluating closure of trucks, indoor or controlled unloading and absence of EPS particles around the unloading area, supported by photos showing the material’s trajectory from loading to unloading and commitment to maintain controls during the contract.

✓The overall score is calculated and rounded to two decimals.

✓Risks and special conditions are extensively detailed and concern penalties, guarantees, subcontracting, validity period, question deadlines and site visits.

✓Such as: a mandatory borgtocht (performance guarantee) of 5% of the total contract amount excl.

✓VAT, to be provided within 30 days after award and always before commencement, via one of the legally accepted forms (cash deposit, public funds, joint surety, bank/insurance guarantee in tak 15).

✓Failure to provide the guarantee can lead to formal notice and either a compulsory guarantee via deductions plus a 2% penalty or ambtshalve measures, and the guarantee may be used to cover delays, poor performance or non-performance.

✓The offer is binding for 90 calendar days from the day after opening.

✓There is a strict sanctions regime (boetes bij vertraging, speciale boetes, measures of ambtswege), with specific procedures and deviations from general execution rules, including separate invoicing of fines (later offset against payments or guarantee if unpaid) and rapid in-gebreke-stelling by email/fax with short response times due to the public cleanliness and safety nature of the service.

✓Bidders must hold sufficient insurance (civil liability, own damage) with specified coverage and notification clauses, and immediately report relevant damage events.

✓Subcontracting is allowed but regulated: the bidder must specify in the offer which parts are subcontracted, identify subcontractors and overslagstations, obtain their engagement, and remains solely responsible to MIWA, with only exceptional replacements permitted subject to prior approval.

✓There is a strict notification duty for any errors or contradictions in the tender documents: such issues must be reported in writing by registered letter and email at the latest 10 days before the offer deadline, otherwise bidders are deemed to fully and unconditionally accept the documents and can no longer invoke ambiguities or errors.

✓Contradictions or corrections within the documents are handled via explicit hierarchy and a formal complaint/clarification mechanism.

✓Such as: the bestek notes that certain general execution rules (KB Uitvoering articles 25, 44, 72, 160) are deviated from for this contract, and these specific clauses override the standard rules for this tender.
