Typebestek voor het transport en de verwerving van EPS (MIWA EPS 2026)
The input text concerns a Belgian public procurement procedure for transport and recovery (recycling) of EPS (geëxpandeerd polystyreen) for MIWA, a Flemish intercommunal waste authority.
It sets out legal, technical and administrative rules for bidders within the framework of Belgian and EU public procurement law.
The perspective is that of Belgium (references to Belgian laws, KB’s, Belgian institutions such as Fost Plus and MIWA, and Belgian/European procurement platforms).
The text first provides general background on the nature and duration of the assignment.
It is a services contract against price list for transport, collection and processing of EPS fractions from recyclageparken.
The initial contract period runs from 1 January 2027 to 31 December 2028, with a minimum of 2 years and a maximum of 4 years through up to two annual extensions confirmed by registered letter.
It specifies that the contract documents are available via the Belgian e-Procurement portal and that offers must be submitted electronically (no paper or email) by 9 November 2026 at 9:00 via publicprocurement.be, using appropriate electronic certificates/eToken and in Dutch.
Regarding what the bidder must submit and minimum qualification requirements, the text describes in detail the form and content of the offer and the required supporting documents.
Such as: the use of the provided tender form, clear indication of lots (percelen), unit prices, global prices and total price (excl./incl. VAT), and a legally valid electronic signature by an authorised person (with evidence of signing authority if needed).
Bidders must attach documents for evaluation of award criteria (e.g. descriptions of quality assurance, logistics, safety, environmental management, complaints handling, transport organisation and EPS-deeltjesbeheersing) and other information such as copies of insurance policies, proof of compliance for any cross-border transport, and all permits and authorisations needed (e.g. recognition as non-hazardous waste collector, exploitation permits, fire safety, electrical conformity, including for any overslagstation).
Minimum selection requirements include financial capacity (such as a statement of global turnover for the last three financial years) and technical capacity (such as proof of registration in the Kruispuntbank van Ondernemingen and at least two comparable assignments in the last three years with certificates or declarations showing proper performance).
Show all 37 statements
Bidders must also submit a completed Uniform Europees Aanbestedingsdocument (UEA) in XML and PDF, and later provide supporting documents including recent attestations for fiscal and social obligations and uittreksels uit het strafregister for the legal entity and all board/management/control members.
The scope of the contract is defined in terms of what, how much, where and when.
Such as: provision of EPS collection bags, collection of EPS from MIWA’s recyclageparken, transport (including possible overslagstations) and processing/recycling of the EPS material, all under the contract conditions.
The contract is structured in lots (percelen) with the possibility for bidders to offer price reductions if awarded multiple lots, which must be explicitly stated.
The text sets out that all relevant costs are included in unit prices: transport and recycling, supply of bags, administration, travel and insurance, documentation, any training, and all legally required safety and health measures (excluding VAT as a separate item).
The period of performance is tied to the contract duration (starting 1 January 2027), with organisational details further elaborated in Part II (e.g. recyclagepark organisation, material description, infrastructure, EPS collection area, safety measures), and bidders must allow visits to their installations by MIWA and/or Fost Plus as part of offer examination.
Award criteria and weighting focus on the economically most advantageous tender based on best price-quality ratio.
Such as: price of the services is scored on 80 points, calculated in function of the lowest offer price, and encompasses separate prices for supplying EPS collection bags, collection and processing.
Innovation and sustainability of processing and transport are scored on 20 points, broken down into subcriteria.
The verwerkingsproces counts for 14 points, considering recycling yield (recyclinggraad versus energy valorisation of the remainder) with threshold levels (≥95%, ≥90–95%, ≥85–90%) and circularity of applications (e.g. circular packaging products, general plastic products, other uses like concrete or insulation).
Milieubescherming (EPS-deeltjesbeheersing) counts for 6 points, evaluating closure of trucks, indoor or controlled unloading and absence of EPS particles around the unloading area, supported by photos showing the material’s trajectory from loading to unloading and commitment to maintain controls during the contract.
The overall score is calculated and rounded to two decimals.
Risks and special conditions are extensively detailed and concern penalties, guarantees, subcontracting, validity period, question deadlines and site visits.
Such as: a mandatory borgtocht (performance guarantee) of 5% of the total contract amount excl.
VAT, to be provided within 30 days after award and always before commencement, via one of the legally accepted forms (cash deposit, public funds, joint surety, bank/insurance guarantee in tak 15).
Failure to provide the guarantee can lead to formal notice and either a compulsory guarantee via deductions plus a 2% penalty or ambtshalve measures, and the guarantee may be used to cover delays, poor performance or non-performance.
The offer is binding for 90 calendar days from the day after opening.
There is a strict sanctions regime (boetes bij vertraging, speciale boetes, measures of ambtswege), with specific procedures and deviations from general execution rules, including separate invoicing of fines (later offset against payments or guarantee if unpaid) and rapid in-gebreke-stelling by email/fax with short response times due to the public cleanliness and safety nature of the service.
Bidders must hold sufficient insurance (civil liability, own damage) with specified coverage and notification clauses, and immediately report relevant damage events.
Subcontracting is allowed but regulated: the bidder must specify in the offer which parts are subcontracted, identify subcontractors and overslagstations, obtain their engagement, and remains solely responsible to MIWA, with only exceptional replacements permitted subject to prior approval.
There is a strict notification duty for any errors or contradictions in the tender documents: such issues must be reported in writing by registered letter and email at the latest 10 days before the offer deadline, otherwise bidders are deemed to fully and unconditionally accept the documents and can no longer invoke ambiguities or errors.
Contradictions or corrections within the documents are handled via explicit hierarchy and a formal complaint/clarification mechanism.
Such as: the bestek notes that certain general execution rules (KB Uitvoering articles 25, 44, 72, 160) are deviated from for this contract, and these specific clauses override the standard rules for this tender.
It also states that the published notices and rectifications in the Belgian Bulletin der Aanbestedingen and the EU Official Journal form an integral part of the tender and must be taken into account by bidders.
Additionally, in case of conflict between the general legal framework and specific clauses, the bestek expressly flags where it departs from the KB Uitvoering, meaning those tailored provisions apply for this contract.
Only the contracting authority's tender documents are binding. As of: 25/10/2026
