… does not allow for the possibility of submitting partial tenders. The subject of the contract is indivisible and constitutes an integral technological and construction whole. Renovation and thermomodernization works within one building implemented as a functioning object are closely dependent on each other (e.g. the installation of windows must be integrated with wall treatment and insulation). The division into parts and the introduction of several contractors into one active facility would create a serious threat to the proper coordination of work, safety and continuity of use, could lead to delays, as well as dilution of liability for executive defects and loss of warranty rights. 5. The contracting authority does not allow variants to be submitted. 6. The contracting authority does not provide for the possibility of awarding the contracts referred to in Article 214(1)(b) CTMR. 1 point 7 of the Public Procurement Act 7. The method of verifying the employment of those persons and the contracting authority’s power to check the contractor’s compliance with the requirements relating to the employment of those persons and the penalties for failure to comply with those requirements are set out in detail in the draft contract, which constitutes Annex 2 to the ToR. 9. The contracting authority does not reserve the obligation for the contractor to perform the key tasks of the contract for construction works in person. 10. Where the description of the subject-matter of the contract (technical documentation) contained in Annex 1 to the ToR refers to standards, technical assessments, technical specifications and technical reference systems, the Contracting Authority accepts the possibility of using solutions equivalent to those described. 11.
