The contracting authority shall not provide for the award of the contracts referred to in Article 214(1)(b) CTMR. 1 point 7 of the Public Procurement Act The contracting authority does not provide for reimbursement of the costs of participation in the procedure. The contracting authority shall not grant advance payments for the performance of the contract referred to in Article 442(1)(b) CTMR. 1 of the Public Procurement Act. The contracting authority does not allow the submission of partial tenders. The task requires the complete preparation of design documentation covering the entire wastewater collection and treatment process in the Rudniki . catchment. The individual elements are interrelated and have a direct impact on each other. In the implementation of the whole task, the individual elements of the task must be taken into account and cooperate with each other. It is required that the prepared documentation takes into account the overall aspect of wastewater management in the municipality of Rudniki. It is not justified for the task to be divided into parts because it would make it difficult to obtain funds and extend the time of the entire investment process. The subject of the contract is the execution of separate, complete design and cost documentation together with obtaining, for the Ordering Party, a decision on the building permit for: 1) extension and modernization of the wastewater treatment plant in Rudniki, 2) reconstruction of the wastewater treatment plant in Żytniów along with the construction of a discharge pipeline to the wastewater treatment plant in Rudniki. In the first stage of the task, the Contractor will prepare at least three variants of design solutions (including material variants), presenting the advantages and disadvantages of each of the proposed solutions. In the second stage, on the basis of the accepted concept, the Contractor will develop complete design documentation for the task entitled: ‘Modernisation of waste water treatment plants in Rudniki and Żytniów’. The design documentation should cover at least the following industries: 1) construction, 2) installation and sanitary, 3) technological with calculations and mechanical, 4) electricity, 5) AKPiA (control and measurement equipment and automation), including monitoring and control, 6) road, 7) land development and installation, 8) studies, permits, arrangements, decisions and guidelines necessary for the implementation of the investment, 9) information on safety and health protection (BIOZ), 10) indication of ICT components that may be present in the design studies. The contractor will prepare the design documentation in such a way that two separate building permit decisions can be obtained: 1) for the extension and modernization of the wastewater treatment plant in Rudniki, 2) for the reconstruction of the wastewater treatment plant in Żytniów along with the construction of a discharge pipeline. The detailed scope of the contract is included in the description of the subject-matter of the contract - Annex 6 to the ToR. The Contracting Authority has analysed the activities carried out as part of the performance of this contract and declares that, due to the specificity of the subject of the contract, it does not specify the requirements for the employment of persons on the basis of the employment relationship referred to in Art. 1 of the Public Procurement Act.
