… solutions cannot be considered as identical solutions, but only those that in the compared features indicate exactly the same or very similar value in use. By indicating the manufacturer's names, trademarks, standards, approvals or reference systems, the Ordering Party aimed to determine the minimum quality parameters and performance characteristics that goods must meet in order to meet the requirements set by the Ordering Party and constitute only a quality standard of the subject of the contract. By the provision concerning the minimum requirements of quality parameters, the Ordering Party understands the requirements of goods contained in generally available sources, catalogues, manufacturers' websites, and the like. Operating with examples of manufacturer's names is only aimed at clarifying the level of expectations of the Ordering Party in relation to a specific solution, the Ordering Party informs that whenever the design documentation and technical specifications for the execution and acceptance of construction works indicate the origin (brand, trademark, manufacturer, supplier) of materials or indicate standards, approvals, technical specifications or reference systems referred to in Article 101 of the Public Procurement Law Act, the Ordering Party allows the offering of materials or solutions "equivalent" in terms of technical, functional and operational parameters, provided that they guarantee the implementation of the works in accordance with the building permit issued and ensure that technical parameters not inferior to those assumed in this tender specification are obtained, and through their use, the functionality of the subject of the contract will be achieved to no less extent than using the solutions used by the Contractor in the project. d) The required warranty period: The minimum warranty period is 24 months. The maximum warranty period is 36 months. Tenders with a guarantee period of less than 24 months will be rejected. (e) Time limit for performance of the contract: 24 months from the date of conclusion of the contract. f) The Ordering Party, in accordance with Art. 1 PPL, requires the contractor or subcontractor to employ, on the basis of an employment relationship, persons performing the following activities in the performance of the contract: • Sub-technical staff – organisation and implementation of field work related to assembly, • Manual staff – direct implementation of assembly and other field work. The Ordering Party allows for the possibility of personal execution of the order by persons conducting business activity or partners of a commercial law company. · 1. Description of the subject of the contract: a) The subject of the contract is a service consisting in maintaining devices and networks related to DIP boards in the City of Krakow: b) The Ordering Party described the subject matter of the order by means of: • draft provisions of the contract (PPU) constituting Annex 2 to the tender specifications, • description of the subject-matter of the contract (OPZ) with annexes constituting Annex 5 to the tender specifications, c) Date of performance of the contract: 24 months from the date of conclusion of the contract.
