In order to ensure a balance between the need to (i) promote maximum participation and access for MSMEs, and, in any case, (ii) rationalise expenditure and streamline the purchasing process, in accordance with Article 58(4) of Legislative Decree No 36/2023, each competitor – while being able to submit a tender for all the lots in which the tender is organised – may not be awarded more than one lot; the relevant award will be made in descending order of the economic amount of the lots, starting from the highest value. If it is not possible to proceed with the award of one or more lots due to the lack of tenders following the above, the contracting authority reserves the right, in order to ensure that the requirements are met, to award any remaining lots, even by way of derogation from the aforementioned award limit, if valid tenders are submitted by competitors who have already been awarded a lot, provided that they meet the relevant requirements. In particular, the service deals with the following types of EER Codes: - Passive codes, for which the supplier will receive an amount for the quantity (kg, liters or cubic meters, or number of withdrawals in the case of ambulatory and sanitary waste) of waste actually transported and delivered to the final destination. The unit amount for each code is to be understood as including also the costs of loading, transport and delivery; - Codes free of charge, for which the service will be carried out by the successful tenderer without payment of a fee; - Active codes, for which the contractor will pay RAI the consideration indicated in the tender and valid for the entire duration of the Contract. For the detailed description of the technical and functional characteristics of the Service as well as the methods of execution of the same and the details of the intervention sites, please refer to the Service Project. Under Article 58 of the Code, the contract is divided into the following four lots: o Lot 1: Service for the disposal of special waste produced at the Rai settlements in Rome; o Lot 2: Service for the disposal of special waste produced at the Rai settlements in Turin; o Lot 3: Service for the disposal of special waste produced at the Rai settlements in Milan; o Lot 4: Service for the disposal of special waste produced at the Rai settlements in Naples. Taking into account the relevant principles, the perimeter of each lot was defined by applying a geographical criterion for a balance between different objectives: maintain a logic of territorial continuity for the pre-eminent need related to an efficient management of the contractual performance and, at the same time, allow the participation of micro, small and medium-sized enterprises (MSMEs) able to modulate their offer in relation to potential territorial specificities.
