Public procurement conditions for Close Air Support training services

The input text contains procurement conditions and forms related to a Lithuanian defence and security public procurement for Close Air Support (CAS) training services for JTAC/air support control specialists.

It is clearly written from the point of view of Lithuanian contracting authorities (Lietuvos kariuomenė, Gynybos resursų agentūra) and repeatedly refers to Lithuanian legislation (VPAGSSĮ, GĮ, VPĮ) and Lithuanian registers and authorities.

No other countries’ procurement frameworks are described, though foreign bidders and foreign documents are mentioned in terms of how they must be legalized or certified.

The text focuses mainly on what the bidder must submit and minimum qualification/exclusion requirements.

Such as: bidders must file an application form (“PARAIŠKA DĖL ARTIMOS ORO PARAMOS PASLAUGOS VIEŠOJO PIRKIMO”), fill in annexes like “Informacija apie tiekėją” (Annex 6) for each supplier/subsupplier/subcontractor/other economic operator, provide company establishment documents or identity documents (for legal/natural persons), lists of ultimate owners and operating countries, and detailed information on the offered services.

They must also provide proof that none of the mandatory and optional exclusion grounds in VPAGSSĮ 34 apply (no relevant criminal convictions, not insolvent, no serious professional misconduct, compliant with taxes and social security, no misleading information, not listed as unreliable, etc.), either via Lithuanian registers (when established in Lithuania) or competent foreign authorities’ certificates (legalized/Apostille where required) or sworn/official declarations if such certificates do not exist.

Minimum qualification requirements are described in detail.

Such as: the bidder must have, in the last 5 years (or since registration if shorter), properly provided artimos oro paramos kontrolės specialistų mokymo paslaugas / CAS flights for JTAC/JPUVS or similar specialists with a cumulative contract value of at least 300,000 EUR (excluding VAT).

This must be proven by a filled Annex 4 list of contracts (client, subject, contract number/date, period, value, contacts) and client testimonials signed physically or with qualified e-signature; the contracting authority may contact these clients.

The bidder must also propose at least one pilot (specialist) with: valid NVG/NVIS qualification and right to fly with night vision devices; CAS training and qualification according to NATO ATP-3.3.2.1 and US JP 3-09.3; and at least 300 flight hours on combat aircraft, evidenced by certificates, flight logs, or similar documents.

Additional requirements mention BASIC JTAC Training NATO or equivalent, and, if the pilot is not an employee, a signed consent, activity license (individual activity/verslo liudijimas) or equivalent proof of business registration.

For groups of economic operators, qualifications are combined according to their respective obligations; reliance on other entities’ capacities is allowed only if those entities themselves perform the relevant part of the contract, and subcontractor specialists must also meet the qualification if they perform qualified tasks.

National security requirements are a separate important requested topic.

Such as: bidders must submit a “NACIONALINIO SAUGUMO REIKALAVIMŲ ATITIKTIES DEKLARACIJA” confirming that the supplier, its subcontractors, relied-on entities, manufacturers and controlling persons are not registered in, or citizens/residents of, states/territories listed in VPĮ 92(14), and that goods/services/components are not manufactured there.

They must also provide, upon request, extensive ownership and activity information via Annex 6 (ultimate owners, controlled companies, countries of operation, cooperation partners).

The contracting authority will assess whether the supplier poses a national security risk and, if necessary, seek information from competent institutions.

The supplier must promptly inform the authority of any changes in submitted data during the procedure.

These elements are presumably contained in other parts of the procurement documentation not included here.

Tactics

When contracts were awarded in this country and sector, usually about 3 bids came in. A normal field for this market. (Based on 152 completed awards — not a statement about this procedure.)

This procedure allows 28 days between publication and deadline — typical in this country is 34 (median of 481 procedures). Much tighter than usual: the first week counts.

Foreign bidders

In Lithuania, 769 contracts went to foreign companies over the last 3 years (of 26,809 recorded awards) — mostly from Germany, France, Romania.

Submission language: Lithuanian, English.

Measured from linked award data; foreign winners bidding through a local subsidiary count as domestic — the true share is higher.
