L’objet du marché est l’exécution des prestations de gardiennage couvrant l’ensemble des sites du Pouvoir Adjudicateur, comprenant les prestations suivantes: • Gardiennage statique ; • Gardiennage mobile ; • Lesson rounds virtuallles ; • Les prestations de monitoring et la gestion des alarmes; • Interventions après alarme. Les prestations sont à effectuer sur 3 sites d’exploitation et 39 sites techniques tous situés dans les 19 communes de la Région de Bruxelles-Capitale. Le marché n’est pas divisé en lots. Le but du marché est de conclure un Accord-Cadre en cascade avec les 2 premiers Soumissionnaires classés suivant les critères d’attribution. Seul le Soumissionnaire classé premier suivant les critères d’attribution sera considéré comme Adjudicataire « actif ». L’autre Soumissionnaire, (classé deuxième), sera considéré comme Adjudicataire « de réserve ». Son contrat pourra être activé…

… qu’en cas de défaillance de l’Adjudicataire actif. Dans ce cadre, le Pouvoir Adjudicateur se réservera, tout en respectant la réglementation sur les marchés publics, le droit de faire appel à l’Adjudicataire de réserve ayant remis la 2e offre économiquement la plus avantageuse sur la base des critères d’attribution de l’Accord-Cadre (principle of cascade). Par conséquent, l’Adjudicataire défaillant, conformément aux mesures d’office prévues dans l’AR du 14/01/2013 établissant les règles générales d’exécution des marchés publics, verra son contrat, pour ledit Accord-Cadre, résilié, et ce pour le reste de la durée de l’Accord-Cadre.
