… included in the Public Service Contract approved by Government Decision No 1453/2022, of the Diesel railcars (DMU) to be rented, within a maximum of 90 days from the date of signing the framework agreement. If the contracting entity does not obtain the agreement from the Railway Reform Authority, the Framework Agreement will automatically terminate, without the intervention of the courts. The basis on which the suspension clause was introduced is the provisions of Annex no. 1 to GD no. 1453/2022 - Public service contract for the period December 2022 – December 11, 2032 of the NATIONAL SOCIETY FOR FEROVIAR TRANSPORT OF TRAVELERS "C.F.R. CĂLĂTORI" S.A., Article 9. Investments, leasing or leasing operations for capital goods (in the nature of fixed assets), point 9.11., the OTF is authorised to propose and justify the new investment programmes and, where appropriate, programmes for leasing and leasing capital goods (in the nature of fixed assets), financed by the Romanian State, necessary to satisfy the requirements set out in Annex 1.1. and assessed in accordance with Annex 12.4, while the ARF is authorised to approve, reject or amend, as the case may be, such proposals within a maximum of 1 (one) month from the date of their receipt, within the limits of the powers established by the Government Decision approving the SPC 2022-2032.’ Estimated quantities for the Agreement - Sectoral Framework -min. 3 pcs rented - max. 30 pcs rented/ 3 years.
