Overview of the tender conditions for the procurement of black short-sleeved T-shirts

This text describes an international open tender procedure conducted by the Public Security Service under the Ministry of the Interior (Lithuania) for the purchase of a black short-sleeved shirt.

The documents refer to the Law on Public Procurement of the Republic of Lithuania, Orders of the Minister for the Environment of the Republic of Lithuania, as well as European Union legislation and Council Regulation (EU) 2022/576; the procurement is carried out from the perspective of Lithuania and the European Union, with references to EU and NATO states and international agreements.

In the part relating to the preparation and submission of tenders, it is specified that the supplier must submit a signed tender in accordance with the form set out in Annex 6, completed in the ESPD (Annex 5, in .xml format), the joint venture contract (if a group is involved), documents confirming the signatory’s authority, the technical specification completed in accordance with the Annex to the Specific Terms and Conditions and, if he relies on the capacities of other economic operators or uses subcontractors, evidence of the availability of those resources, a declaration of consent to be a subcontractor and documents of joint and several liability (if such a condition applies).

By way of example, the tender form requires the identification of the supplier, the bank details, the names of the subcontractors and the percentage of the liabilities.

In the part of the object and scope of the contract, it is stipulated that a black short-sleeved T-shirt is purchased, the purchase into lots is not split, and the maximum value of the contract is EUR 115 000.00 excluding VAT.

The technical specification (Annex 2) specifies that products must be sewn from knitted material, comply with LST EN 13402 and LST ISO 8559 or equivalent standards, environmental protection criteria in accordance with Order No D1-508 of the Minister for the Environment, and must be based on the Ecolabel (e.g.

European Ecolabel, Öko-Tex) or the test reports of a notified laboratory.

According to the information provided, suppliers must deliver male and female model competition samples in black (between Pantone Textile 19-4205 TPX and 19-0303 TPX or equivalent), in specific sizes, to the address of the Public Security Service M. K. Paco g. 4, Vilnius before the deadline for submission of tenders.

The special conditions of the draft contract emphasize that orders will be placed in instalments according to the need, the minimum quantity of one order is 500 pcs., and the entire volume of goods provided for in the contract must be delivered no later than 5 months after placing an individual order.

The evaluation part of the tenders provides that the most economically advantageous tender shall be selected on the basis of the price-quality ratio and the evaluation criteria are set out in Annex 7. The price shall be given a weighting of 70 points; requires that the bid price does not exceed EUR 139 150.00 including VAT.

Technical advantages shall be awarded 30 points and at least three parameters shall be evaluated, such as: resistance to budding in accordance with LST EN ISO 12945-2 (ranges of 4-5 degrees with appropriate scoring), stain resistance to artificial light in accordance with LST EN ISO 105-B02, and dimensional change after washing and drying in accordance with LST EN ISO 5077 and LST EN ISO 6330; technical superiority scores shall be calculated on the basis of the following formulae, by comparing the difference between the baseline requirement and the maximum difference between tenders.

As indicated above, the total value of the score L is calculated as the sum of the scores for the price and the three technical parameters, and the tender with the highest L is awarded.

The Risks, Special Conditions and Contractual Obligations section covers national security provisions, penalties and guarantees, rules on subcontracting, tender and contract periods, time limits for questions and subject-matter inspection.

It has been established that suppliers, sub-suppliers and economic operators whose capacities are invoked may not participate in this procurement if they are not registered or permanently resident in EU, NATO Member States or countries that have signed the agreements referred to in Article 17(4) of the Law on public procurement.

Contract enforcement means penalties (default interest, fines) in accordance with point 9.3 of the draft contract; The general terms and conditions of the contract provide for the mechanics of securing the performance of the contract and the possibility for the Buyer to use the security in case of violations.

New subcontractors, the capacity of which the supplier has not substantiated the qualification, may be used after informing the Buyer 5 working days in advance and with written consent; The buyer checks that the subcontractor is not covered by the exclusion grounds and that it complies with national security requirements.

The general provisions of the Treaty establish a hierarchy of documents: first technical specification followed by special conditions, general conditions, procurement documents, tender and other annexes; this means that in the event of a conflict between the notice and the procurement conditions, the information given in the notice, the special conditions between the special conditions and their annexes, the special conditions between the special conditions and the general conditions of the procurement, shall be considered to be correct.

The general terms and conditions of the procurement also state that more recent revisions of the procurement documents take precedence over older ones, so suppliers must refer to the latest version of the documents.

Tactics

When this buyer has awarded in this sector, usually only one or two bids came in. A solid bid has a real chance here. (Based on 3 completed awards — not a statement about this procedure.)

This procedure allows 30 days between publication and deadline — typical in this country is 34 (median of 481 procedures). Much tighter than usual: the first week counts.

Foreign bidders

In Lithuania, 769 contracts went to foreign companies over the last 3 years (of 26,809 recorded awards) — mostly from Germany, France, Romania.

Submission language: Lithuanian.

Measured from linked award data; foreign winners bidding through a local subsidiary count as domestic — the true share is higher.
