… Contracting Entity (EC) states that it will conclude contracts with the successful tenderer only to the extent that the funds necessary for the procurement will be provided by allocating budget appropriations for that purpose. If, for whatever reason, the budget appropriations will not be allocated, the Commission, after receiving notification of the non-granting of funding, reserves the right to cancel the atrib. procedure, provided that there is no other source of funding, cf. Article 225(1)(c) second sentence of Law No 99/2016, making it impossible to conclude the agreement. The tenderers in this procedure understand that EC cannot be held liable for any damage in the event of annulment of the procedure, regardless of its nature and regardless of whether EC has been notified of the existence of such damage. The tenderers in this procedure accept the use of the above special conditions/clause. susp., assuming full responsibility for any damage they may suffer in the situation described. The maximum period for which the susp. clause operates is 7 months from the public date. Notice of participation. in SEAP, so that, if the Minister’s Order is not issued, the atrib. procedure is cancelled.’ In this respect, by participating in this procedure, the tenderers adopt and agree to the provisions of the clause, in their entirety. Deadlines by which requests for clarifications are received from potential tenderers to the DA: - I term: until the 32nd day before the deadline (term.) set for the submission of tenders (of.), - the 2nd deadline: until the 20th day before the term. set for the deposit of. EC will respond clearly and completely to all requests for clarification./info. supplement. as follows: - I term: 24th day before the term. set for the deposit of, - 2nd term: The 12th day before the term. set for the deposit of. In accordance with Article 29(3) of Government Decision No 394/2016, the EC will reply only to the request for clarification submitted by the abovementioned Ec. op. to term. The estimated total value, referred to in the achiz. data sheet in section II.1.5, is: 20,963,628.09lei, excluding VAT. This amount represents an estimate for the works carried out by contract in the amount of RON 20,086,628.09, excluding VAT, plus the amount of the expenses for the establishment of the implementation reserve for the price adjustment in the amount of RON 877,000, excluding VAT. The offers will be valued at an estimated value of RON 20,086,628.09, excluding VAT. The value of miscellaneous and unforeseen expenses is not included in the estimated value of the works, being RON 1.275,000, excluding VAT. Non-substantial amendments shall be made without the organisation of an atrib. procedure, with due respect for Articles 235 to 241 of Law No 99/2016 and with regard to the amounts allocated in the budget of the project for this purpose: 877.000lei without VAT, val. of implem. reserves for adjusting the price + 1.275.000lei without VAT val. ch. miscellaneous and unforeseen
