Art der Leistung Die Bezirksregierung Köln unterliegt als juristische Person des öffentlichen Rechts umfassend steuerlichen Verpflichtungen. Aktuell verfügt sie über einen Betrieb gewerblicher Art (BgA). Durch die Einführung des § 2b UStG ab dem 01.01.2027 wird diese Verpflichtung um weitere Geschäftsvorfälle ergänzt. Des Weiteren unterliegen verschiedene Geschäftsvorfälle bereits aktuell der Umsatzbesteuerung (z.B. inngemeinschaftliche Erwerbe oder § 13b UStG Sachverhalte). Vor diesem Hintergrund sind die regelmäßigen Umsatz- und Ertragssteuererklärungen und Umsatzsteuervoranmeldungen sowie die dazugehörigen Ermittlungen und Berechnungen vorzunehmen. Darüber hinaus sind neue und laufende Geschäftsvorfälle hinsichtlich einer Steuerpflicht zu beurteilen und steuerlich zu beraten. Umfang der Leistung Art und Umfang richten sich nach den jeweils geltenden steuerlichen Vorschriften. Der Arbeitsaufwand wird auf ca. 150 Stunden pro Jahr geschätzt. Daraus ergibt sich ein voraussichtlicher Gesamtabruf von 600 Stunden über die gesamte Vertragslaufzeit von 4 Jahren. Um unvorhersehbare Bedarfsspitzen abzufangen, wird die verbindliche Gesamthöchstmenge für die gesamte Vertragslaufzeit auf 750 Stunden (entspricht dem geschätzten Bedarf zzgl. eines Puffers von 25%) festgesetzt. Die Rahmenvereinbarung ist rechtlich erschöpft und endet automatisch, sobald die Gesamthöchstmenge von 750 Stunden durch Abrufe vollständig erreicht ist.
