Vergabeverfahren Rahmenvereinbarung „Sportartikel Schulen“ der Stadt Fürth (Deutschland)
The input text contains the tender and contractual documents for an open procedure under the German Unterschwellenvergabeordnung (UVgO) for a framework agreement “Sportartikel Schulen – Rahmenvereinbarung” of the City of Fürth.
The country context is explicitly Germany (references to UVgO, VOL/B, BSI, DSGVO, Regierung von Mittelfranken, Stadt Fürth).
The documents define how bidders are to submit offers via the Bavarian e‑procurement platform, what evidence of suitability (Eignung) is required, how the offers are evaluated, and which contractual conditions apply for supplying sports articles to schools in Fürth over several years.
The input text explains, among other things, what the bidder must submit and which minimum qualification requirements apply.
Such as: bidders must use the provided forms and file the offer in German via the platform iTWO tender/ava-sign, with the form L 613 “Angebotsschreiben” and the priced Leistungsverzeichnis (Kernsortiment) as core.
With the offer, the bidder must submit the suitability proof either via AVPQ registration, EEE or the filled form L 124 “Eigenerklärung zur Eignung”, including turnover relating to comparable services for the last three business years, a declaration on comparable references (with at least three references to be named on request), and a declaration to conclude appropriate professional/operational liability insurance (minimum sums will be set by the contracting authority by “+” in L 124).
Additionally, the bidder must submit L 248 (wood products), L 2481 (native plants – formally included even though the subject is sports goods), L 2491 (child labour), L 2496 (Schutzerklärung) and, where applicable, L 234 (Bietergemeinschaft) and L 235 (subcontractors/other companies).
On separate request, certificates matching L 248/L 2481, personal data of directors/procurists, and L 236/L 2495 (commitment declarations for Eignungsleihe) must be provided, failing which the offer is excluded.
The scope of the contract (what, how much, where, when) is defined through the Bekanntmachung L 121, the Aufforderung L 611 and the Besondere Vertragsbedingungen L 614 with its annex.
Such as: the City of Fürth intends a single framework agreement for the supply of sports articles (core assortment plus “Randsortiment”) to Fürth schools.
The place of performance is the city of Fürth (postal code 90762), with deliveries to 12 primary schools, 5 secondary schools (Mittelschulen), 2 combined primary/secondary schools, 2 special schools (Förderzentren), 3 grammar schools, 2 Realschulen, 1 business school and 3 vocational schools.
The basic contractual period is 01.01.2027–31.12.2027 with three one‑year extension options up to maximum 31.12.2030 or until the overall call-off maximum of 200,000 EUR gross or the “Abrufhöchstmenge” is reached.
Show all 36 statements
The estimated annual volume is about 50,000 EUR, including approx. 5,000 EUR for the Randsortiment; a maximum of about 200,000 EUR for the total duration is indicated in L 611.
Quantity indications per item in the Leistungsverzeichnis are explicitly “bedarfsabhängig” and serve both evaluation and bidder information; actual call-offs may be higher or lower without claims.
The award criteria and weighting are set out in L 611 (number 9) and L 227 plus its specific annex.
Such as: the sole formal Zuschlagskriterium is “Preis” with 100% weighting.
The “Preis” is not just the sum of unit prices; instead a Wertungssumme P is calculated as the sum of: (1) offer sum for the Kernsortiment (LV), (2) a fictive annual volume of 5,000 EUR for the Randsortiment minus the offered discount, and (3) a fictive 5 orders per year multiplied by any Mindermengenzuschlag offered.
This Wertungssumme is then transformed into 0–10 points: 10 points for the lowest Wertungssumme, 0 points for twice that or worse, with linear interpolation between.
The contract also incorporates a 10% evaluation preference (Abschlag auf den Preis) for “bevorzugte Bieter” (e.g. workshops for disabled persons, inclusion companies, blind workshops), applied only to their share within joint bids; where offers are equally economical, the preferred bidder gets the award.
L 227 also mentions potential qualitative sub‑criteria (1.2–1.4), but for this tender they are not used; the annex clarifies that only price, Randsortiment discount and Mindermengenzuschlag are evaluated.
Such as: the offer must remain binding until the end of the “Bindefrist” (19.11.2026).
Questions on the tender documents must be submitted via the platform by Friday, 13.11.2026, 11:00; this guarantees answers at least three calendar days before the offer deadline (18.12.2026, 11:00).
Only electronic submission via the platform (iTWO tender/ava‑sign) is allowed; “eine schriftliche Einreichung ist nicht zugelassen”.
Offers not submitted form‑ and time‑compliant or without clearly identifiable bidder (in text form or with required signature/seal) will be excluded.
Security for contract performance: the Bekanntmachung L 121 contains option fields for a 5% performance guarantee from 50,000 EUR net upward, but the marked selection is “keine Sicherheit”, so in this tender no contract performance security is required.
The BVB annex excludes the bidder’s own general terms (AGB), requires full availability of the core assortment throughout the contract, limits partial deliveries to exceptions, mandates free and unconditional handling of returns and exchanges, sets packaging to 100% recycled material at no charge and obliges the contractor to set up an internet ordering platform with marked core assortment and stored contract prices/discounts.
Subcontracting and Eignungsleihe must be declared in L 235 and backed, on request, by L 236 commitment declarations; in case of Eignungsleihe for financial/economic capacity, the third party must jointly and severally (gesamtschuldnerisch) co‑liability.
Bietergemeinschaften must file L 234 and are jointly liable.
No site visit is mentioned; the data processing conditions (L 244, L 2441, L 2440, L 2442) regulate electronic data exchange and DSGVO information.
Regarding contradictions or corrections, the documents also clarify which statement prevails.
Such as: L 612 and L 613 explicitly state that the Langfassung des Leistungsverzeichnisses provided by the contracting authority is solely binding; any bidder’s own short LV is only a working copy.
L 244 states that in case of discrepancies between data exchange files and written versions of accounting documents, the written version prevails.
The BVB annex (Anlage L 614) states that the bidder’s general terms are excluded, ensuring that only the City’s conditions (VOL/B, L 614, L 615, contractual annexes) apply.
A further potential ambiguity arises because L 615 generically provides clauses on Kleinstauftragszuschlag and re‑assignment of restleistungen, whereas L 614 explicitly declares that L 615 numbers 2 and 5 do not apply; thus, if there is any conflict, L 614 (with its specific exclusion) is controlling.
Also, L 121 generically allows the possibility of a performance security, but the specific marking “keine Sicherheit” in the notice is decisive for this tender.
Where generic VHB/VHL text refers to Nebenangebote, L 611 and L 121 clearly state “Nebenangebote sind nicht zugelassen”; this exclusion governs.
Only the contracting authority's tender documents are binding. As of: 31/10/2026
