Procurement procedure ‘Modernisation Public Lighting FL Birkheidering, Berlin’ – Overview of tender requirements
The input text contains the procurement documents for a VOB/A procurement procedure of the Land of Berlin (Germany) for the ‘Modernisation of Public Lighting’ (overhead line lighting FL Birkheidering) in the district of Treptow-Köpenick.
It is a construction project in civil engineering/traffic plant construction, carried out via the Berlin Procurement Platform (RIB Tender).
Russia and Ukraine occur only in the context of the EU Sanctions Regulation; the relevant point of view is that of a German contracting authority (Land Berlin) within the EU legal framework.
In terms of content, the documents regulate the participation and technical conditions, the submission of tenders (only in electronic form in text form), the model forms to be used, the suitability requirements and evidence, the contractual conditions (including deadlines, securities, contractual penalties, environmental and social conditions) and the evaluation of tenders.
Numerous standard forms (V 1210e, V 211e, V 212, V 213, V 214.V‐I, V 124.V‐I, V 233, V 238, V 246, V 247, V 248, V 250, V 255, host‐236, etc.) are used, some with berlin-specific additions.
The documents to be submitted by the tenderer with the tender include in particular: the tender letter without lots (V 213.V-I F), the self-declaration of suitability (V 124.V-I F) or indication of the PQ/ULV number, the list of subcontractor services (V 233.V-I F), if applicable, the declaration of commitment of other contractors (host‐236) in the case of subcontracting/fitness loan, the declaration of the consortium (V 238 F), waste declarations (V 2413 F and waste form 1 V 2411 F), the supplement to the offer for the promotion of women (V 246 F), the completed list of services in GAEB and PDF format, the self-declaration of Russia sanctions freedom, product-related documents such as data sheets, assembly instructions, Eulumdat files (.ldt) and file ‘Leuchten Bieterangaben’ as well as up-to-date proofs of safety and registers (health insurance fund, professional association, tax office, trade register extract/commercial application).
The minimum qualification requirements concern legal reliability, economic and financial capacity, and technical and professional capacity.
Prequalified companies prove their suitability via ULV/prequalification register, non-prequalified companies via V 124.V-I F (incl. declaration on grounds for exclusion, insolvency exemption, tax and social security contributions, registrations, professional association membership, required minimum annual turnover – amount is still recorded concretely by the contracting authority – and turnover of the last three years in the contract area).
In addition, special qualifications must be demonstrated in accordance with the relevant ZTV regulations in civil engineering, and there are special requirements from Berlin public procurement law: Tariff compliance, minimum hourly pay, promotion of women, compliance with ILO core labour standards and compliance with environmental protection requirements, which must be proven by quality marks (e.g.
Blue Angel, EU Flower) or equivalent technical evidence.

Specific quantities (e.g. number of luminaires, masts, cables) can be found in the schedule of services, which is mentioned here only as a reference (‘list of services/service programme with prices’).
This results in a possible execution phase from the beginning of 2026/2027 to autumn 2027.
This order of dates is contradictory, as the period of validity is usually after the time limit for submission of tenders; the opposition should be clarified by asking the contracting entity, considering the entry in the notice form V 1210e F as the primary source.
A mandatory site visit is not mentioned in this text; there is only general talk of communication via the platform.
In V 211e F it is stated that the evaluation sum is determined from the recalculated tender sum, taking into account price-favourable basic/choice positions, monetised award criteria (if any), discounts without conditions, any reimbursement amount from wage slip clauses and maintenance offers. workshops for the disabled will receive a 15% bonus on the total value, and in the case of equal economic offers, the contract will be awarded; proof of workshop status must be provided with the tender.
Subsidiary offers are in principle only permitted if this is enabled under point 6.2 in V 211e; the standard conditions of participation V 212 regulate minimum requirements and proof of equivalence of side offers; in the specific procedure, point 6.1/6.2 determines whether side offers are admitted or excluded – in one variant it is expressly stated that ‘side offers are not admitted, point 4 of the conditions of participation (V 212) does not apply’.
Special risks and contractual conditions arise primarily from the Special Contractual Conditions (V 214.V-I F) and the numerous BVB forms (V 231/232, V 246, V 247, V 248, V 250, V 255).
The following provisions shall apply to the provision of collateral: waiver in principle, but as soon as the amount of the contract in a public tender is at least € 250,000 excluding VAT, a contract performance guarantee of 5% of the amount of the contract must be provided; after acceptance, a security for claims for defects of 3 % of the sum of the advance payments must also be provided.
Guarantees are to be provided exclusively with the contracting authority forms V 421, V 422, V 423.
Social and tariff compliance risks are regulated by V 231/V 232 (minimum hourly pay/tariff loyalty), V 246 (promotion of women), V 247 (ILO standards), V 248 (environmental protection) and V 250 (prevention of disadvantages), including strict obligations to pass on these obligations along the subcontracting chain and control and sanction mechanisms (V 255 F: controls, penalties, termination, rescission, reduction and compensation rights).
On the subject of subcontractors/subcontractors, V 212 stipulates that the nature and scope of the services to be performed by subcontractors must be specified in the list of subcontractor services (V 233 F) and that, on request, the subcontractors must be named and their suitability (PQ/ULV number or self-declarations with supporting documents) must be proven.
Consortia must make a joint declaration (V 238 F) stating that, in the case of a contract, they will form a consortium, appoint an authorised representative and be jointly and severally liable; the contracting entity may request a declaration (qualified) signed by all members.
Only the contracting authority's tender documents are binding. As of: 28/10/2026
