… swimming pool in accordance with applicable law, in particular with the Act of 18 August 2011 on the safety of persons staying in water areas (consolidated text: Dz. Journal of Laws 2023, item 714 as amended) and the implementing acts issued to it, b) control over compliance with the generally applicable provisions of law in the field of safety and use of water facilities and the provisions of the swimming pool regulations, c) perform with the utmost care all duties specified in the scope of duties of a rescuer, d) ensure the provision of services by persons with appropriate qualifications and qualifications, in accordance with currently applicable law, e) ensure the staffing of one rescue station, in accordance with applicable regulations, during swimming pool operating hours, f) provide qualified first aid, and in more serious cases call of the Medical Rescue Team, g) ongoing equipping rescuers with outfits and footwear in accordance with health and safety requirements, h) take care of the position of providing services and maintenance of the entrusted equipment, and) maintain basic documentation and reporting system, j) comply with the following procedures: • placing, handing over and terminating on-call duty, • emergency services, in the event of accidents at various places of the facility, • providing qualified first aid, • communications, k) defining and respecting the scope of duties and activities of water rescuers in the swimming pool. 2. The Contractor shall assume full legal and material liability for any damage resulting from non-performance or improper performance of his obligations under this contract. 3. The Contractor shall be liable for all acts and omissions of persons at his disposal in the performance of the contract as for his own acts or omissions. 4. In the event of any claims against the Ordering Party related to the provision by the Contractor of services constituting the subject of the contract, the Contractor is obliged to release the Ordering Party from liability in this respect, and in particular to replace the Ordering Party with any pending proceedings. 5. Detailed obligations of the contractor (including the scope of duties of the rescuer and the terms of use of the facility) are described in the draft contract. 6. The services covered by the contract will be provided in accordance with the provisions of this contract and applicable laws, in particular: 1) The Act of 18 August 2011 on the safety of persons staying in water areas (Journal of Laws No. Journal of Laws 2023, item 714, as amended), 2) Regulation of the Minister of Internal Affairs and Administration of 23 January 2012 on the minimum requirements for the number of water rescuers ensuring constant control of a designated water area (Journal of Laws No. Journal of Laws 2022, item 1981, as amended), 3) Ordinance of the Minister of Internal Affairs of 27 February 2012 on the requirements for equipping designated water areas with life-saving and auxiliary equipment, signalling and warning devices, medical equipment, medicines and sanitary ware (Journal of Laws No. Journal of Laws 2022, item 1607 as amended) hereinafter referred to as the Hardware Requirements Regulation
