… arising from the social clause 1) The contracting authority in the procedure in question applies the social clause pursuant to Article 95(1)(b) CTMR. 1 of the Public Procurement Act. 2) The Contractor undertakes to ensure that the construction works for the entire period of performance of the subject of the contract will be performed by persons employed under an employment contract within the meaning of the Labour Code by the Contractor or a Subcontractor. 3) The condition referred to in para. 2 will be fulfilled by hiring new employees on the basis of a contract of employment or by appointing persons already employed for the following works to perform the contract: preparatory and cleaning works, demolition works, finishing works, electrical and teletechnical works, sanitary works. 4) Detailed requirements for employment on the basis of an employment relationship in the circumstances referred to in Article 95 of the Public Procurement Act are included in the draft provisions of the contract constituting Annex 2 to the ToR.
