The delivery of the subject of the contract will be carried out by means of transport of the Contractor authorized for the transport of food. 8. Persons performing the delivery must have a valid medical certificate for sanitary and epidemiological purposes, which they present at the request of the Ordering Party. 9. The contractor is obliged to have a valid certificate of entry in the register of establishments subject to official control by the competent authorities – in accordance with the Food and Nutrition Safety Act of 25 August 2006 (consolidated text: Journal of Laws 2023, item 1448, as amended). The contractor must be subject to constant supervision by the competent authorities. 10. The offered products must meet the requirements listed in the applicable legislation on the production and marketing of food. Each product must be manufactured and placed on the market in accordance with the requirements of the HACCP system. 11. The delivery details are set out in the model contract attached as Annex 5 to the ToR. 12. The Contractor will ensure the protection of the personal data transferred, in accordance with the Personal Data Protection Act of 10 May 2018 (Journal of Laws 2019, item 1781, as amended) and Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (hereinafter referred to as GDPR) (OJ 2016 L 119, p. 1). The Contractor shall be responsible for informing Subcontractors, third parties and consortium members of the processing of personal data. The Contractor’s declaration that he has fulfilled his obligations under Article 13 or Article 14 of the GDPR towards the natural persons from whom he obtained personal data directly or indirectly in order to apply for this contract will be submitted in the tender form, which is attached as Annex 1 to the ToR.
