The subject of the contract is the delivery of a tape library (1 piece) hereinafter referred to as: ‘Equipment’ in accordance with the provisions of the description of the subject-matter of the contract (OPZ), which is attached as Annex 1 to the tender specifications. 2. The Contractor undertakes to provide the Equipment with brand new, full-fledged equipment manufactured in accordance with applicable norms and standards, covered by a minimum of 36 months manufacturer's warranty period (guarantee is one of the criteria). 3. The Contractor guarantees and undertakes that the use of the supplied Equipment by the Ordering Party will not constitute a violation of the copyrights of third parties, in particular, the Ordering Party may not be offered Equipment and software that is registered in the manufacturers' databases as intended for sale or sold to another end customer. 4. … Contractor declares that the offered Equipment on the date of signing the Equipment Acceptance Protocol cannot be intended by the manufacturer for withdrawal from production or sale. 5. The Contractor declares that the delivered subject of the order is equipment purchased in the manufacturer's official sales channel. The Ordering Party reserves the right to verify the above requirement with the representative of the manufacturer of the offered solution. 6. The Contractor is obliged to deliver the equipment to the building of the Marshal's Office in Lublin, ul. Artur Grottgera 4, 20-029 Lublin, on his own, at his own expense and risk, along with bringing the equipment to the premises indicated by the representative of the Ordering Party during the Ordering Party's office hours, i.e. on working days from 7:30 to 15:30. 7. The detailed description of the subject-matter of the contract and the manner of performance of the contract are set out in Annex 1 to the ToR – Description of the subject-matter of the contract and in Annex 3 to the ToR – Relevant provisions of the contract.
