… already been completed. The Contractor shall be obliged to designate the main points by the authorised surveyor and shall be responsible for protecting the designated measuring points until the final acceptance of the works, if any. Damaged or destroyed geodetic signs will be restored and fixed by the Contractor at his own expense, if applicable. Before commencing works in built-up areas, the Contractor shall notify the owners of the property, buildings, including adjacent buildings (if applicable). Before commencing the works, the Contractor shall also notify the institutions concerned and the owners of the underground armaments of the commencement of construction (if any). When carrying out earthworks in the very close vicinity of buildings, special care should be taken and it is absolutely necessary to comply with the provisions of the construction law. The Contractor undertakes to perform the subject of the contract in accordance with the documentation, rules of technical knowledge and construction art, applicable regulations and Polish standards, under the conditions specified in the contract and the Terms of Reference. Devices and materials adopted in the documentation and technical specifications, work measurements, guarantee the achievement of the desired effect. Where references to standards, European technical assessments, approvals, technical specifications and technical reference systems are used in the documentation describing the subject-matter of the contract, the Contracting Authority shall accept solutions equivalent to those described. When analysing the design documentation, the Contractor should assume that each reference used in the design documentation is accompanied by the word ‘or equivalent . Where trade marks, patents or the origin of products/source/specific process that could characterise products or services provided by a particular economic operator are used in the documentation describing the subject-matter of the contract, this means that they are given for example and specify only the minimum expected quality parameters and the required standard. The contractor may use equivalent materials or equipment, but with similar or better technical and quality parameters, the use of which will not in any way adversely affect the proper functioning of the solutions adopted in the design documentation. The contractor who uses equipment or equivalent materials will be obliged to demonstrate during the performance of the contract that the equipment and materials used by him meet the requirements specified by the Ordering Party. Pursuant to Article 101(1) CTMR, 4 of the Public Procurement Law Act, the Contractor using equivalent materials undertakes to use materials with parameters not worse than those specified in the documentation. If the contracting authority accepts solutions equivalent to those described in the documentation, but does not specify the minimum parameters that would confirm this equivalence, the contractor is obliged to offer a product with similar properties, functionally suitable for the required use. The contracting authority may not reject a tender on the sole ground that the works or supplies offered do not comply with the standards, technical assessments, technical specifications and technical reference systems to which the description of the subject-matter of the contract relates, provided that the economic operator proves in the tender that the solutions proposed are equivalently effective.
