… specialist diagnostics of the water supply system and central heating system in order to precisely locate possible damage, without the need to perform further excavations by trial and error. Water flows directly at the wall and foundations of the Kłobuck 16 building in Warsaw. In addition to locating and removing the leak, the Contractor is obliged to renovate the building's waterproofing. The detailed description of the subject-matter of the contract shall be as follows: The draft provisions of the agreement (PPU) constituting Annex 2 to the ToR; Technical documentation, i.e. OPZ, constituting Annex 3 to the ToR and being also Annex 2 to the draft provisions of the agreement, which consists of: • Description of the subject of the contract, • Technical Specifications for the Execution and Acceptance of Works (STWIOR), • Measurements of works, • As-built and auxiliary design drawings for the OPZ. Obligations arising from the social clause 1) In the procedure in question, the contracting authority applies the social clause pursuant to Art. 1 of the Public Procurement Act. 2) The Contractor undertakes to ensure that the construction works for the entire period of performance of the subject of the contract will be performed by persons employed under an employment contract within the meaning of the Labour Code by the Contractor or a Subcontractor. 3) The condition referred to in para. 2 will be fulfilled by hiring new employees on the basis of a contract of employment or by appointing persons already employed for the following works to perform the contract: preparatory and security works, demolition works, earth and insulation works, construction works, electrical works, sanitary works, restoration works. 4) Detailed requirements for employment on the basis of an employment relationship in the circumstances referred to in Article 95 of the Public Procurement Act are included in the draft provisions of the contract constituting Annex 2 to the ToR.
