Subcontractors: a) The Contractor may entrust the performance of part of the contract to a subcontractor. b) The Ordering Party does not reserve the obligation for the Contractor to perform key parts of the contract in person. c) The Ordering Party requires the Contractor to indicate in the tender the part of the contract the performance of which will be entrusted to the subcontractor 1.5. Wherever there are references to Polish Standards in the documentation of proceedings, it is permissible to apply the relevant standards of the European Union countries, to the extent adopted by Polish legislation. Wherever the documentation of the proceedings indicates trade marks, patents or origin in the description of the materials used, it is assumed that equivalent products may be used. The indication of the trade mark, patent or origin shall be indicative only and shall be used to define the quality and class standards required for the materials used. Where the standards and regulations referred to are national or refer to a particular country or region, other appropriate standards ensuring an equal or higher level of performance than the standards or regulations referred to may also be applied. By describing the subject of the contract by reference to standards, European technical assessments, approvals, technical specifications and technical reference systems, the Contracting Authority accepts solutions equivalent to those described. 1.6. An economic operator relying on solutions equivalent to those described by the contracting authority must demonstrate that the supplies, services or works it offers meet the requirements specified by the contracting authority. Equivalence in terms of technical, functional and operational parameters is to ensure, in particular, the achievement of technical parameters not inferior to those assumed in this tender specification. If the documents constituting the documentation of proceedings indicate the trade name of the company, goods or product, the Ordering Party - in relation to the parameters indicated directly in the documentation of proceedings, or data (technical or any other), identifying directly or indirectly the product or product - accepts equivalent solutions in accordance with the technical data and parameters contained in the above-mentioned documentation. Equivalent solutions shall be understood as those with parameters not inferior to those required and included in the documentation.(if applicable) 1.7. The Ordering Party reserves that the products used have valid technical approvals, safety certificates and hygienic approvals. When performing the contract, the Ordering Party shall allow the use of products equivalent in quality and raw materials used for their execution to the products specified in the documentation of the procedure, subject to their approval by the Ordering Party.
